The parcel in question w acquired by the City of Bangor by Tax Liens in 1985; however, there i outstanding a of the property who apparently was not given proper notice, who therefore still has as Interest in the property. THAT , who as, the City of Bangor has previously established the Bair Industrial Park on the northeasterly aide of Ea®ond Street opposite Target Industrial Circle; and WHEREAS. said MaAir Industrial Park requires the extension of sanitary sewer service to serve some of the lots within the subdivision; and WHEREAS. the Installation of said sewer requires the crossing of a parcel of land located on the northeastly side of Bernard Street owned by the City of Bangor by virtue of a Deed dated May ], 1972 and recorded in Penobscot Registry of Deeds in Volume 2129, Page 875, with a partial Interest to said property still owned by Robert J. Treble of Hancock, Maine as described in a Deed dated October 20, 1958 and recorded in Penobscot Registry of Deeds in Volume 1647, Page 49; and WHEREAS, public exigency requires the Immediate acquisition of a sewer easement to permit the installation and future maintenance of the sewer. NOW. THEREFORE. Be It ORDERED, THAT the City Engineer acting for and on behalf of the Municipal Officers acording to law be and hereby is authorized to lay out and establish an easementfor the proposed sanitary sewer across said parcel of land, the location of said sewer more fully described as follows. Beginning at a point on the northeasterly right-of-way line of Removed Street located 470 feet southeast from the southeasterly right-of-way line of MrAir Road, said UnAir Read more fully shown on a Plan entitled "Final Subdivision, BanAir Industrial Park" dated October 17, 1985, Plan No. SD -71 prepared by the City Engineer's Office; thence in a northeasterly direction across said parcel of land for a distance of one hundred sixty-five (165) feet, core or less, to the northerly line of said parcel at a point located ten (10) feet northwest from the southeasterly line of said parcel; said sewer easement e Cc be laid out to a width of twenty (20) Feet, measuring ten (10)feet to either aide and at right angles to the above described line. L`4�' I�nn'troduuccceeed and filed by Py�2.oP .....SGC..../ie. uncilman The purpose of said easement is to permit the City of Hangar or its agents to enter upon the above described parcel as necessary to construct and maintain sanitary sewer and appurtenant structures within said easement area; and be it further ORDERED, THAT the City Engineer proceed to give notice of such intention of said Municipal Officers according to law by pasting such notices for seven (7) days in two (2) public places in the City of Bangor and in the vicinity of the proposed sewer, and the City Engineer is further ORDERED, TO make a written return of said proceedings containing the bounds and admeasurements of said easement and the damages allowed to any person or personsas a result of said laying out, all in accordance with the lava of the State OfMaine.. - -2
