The current City ordinance prohibits snow or ice deposits in any street, lane, or public square of the City and does not specifically prohibit the deposit of snow and ice on sidewalks. It is in the best interests of the citizens of Bangor to keep sidewalks as free as possible of snow and ice. Some property owners have, or have allowed, the depositing of snow and/or ice on sidewalks as they clear their driveways or walkways or have them cleared. This has created problems for the public use of the sidewalks. This ordinance also allows the city to remove the snow and bill the individual or firm that deposited the snow and/or the owner, tenant, firm, corporation, and/or other occupant of the property for the cost of services. The penalty for violation of this ordinance increases from $20 to $100 for deposit of snow on streets, lanes, public squares or sidewalks. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 234-6 of the Code of the City of Bangor be amended as follows: §234-6. Deposits of snow or ice on streets or sidewalks No person shall deposit or cause or allow to be deposited ice or heap eā‚¬ snow in any street or lane or sidewalk or public square of the City. §234-6 - A. Clearing deposits of snow or ice on streets or sidewalks If any person shall deposit or cause or allow to be deposited ice or snow in any street or lane or sidewalk or public square of the City the City Manager may direct the City's Public Works Director to cause the removal or control of such snow or ice, and the person who deposited or caused or allowed to be deposited ice or snow, the owner, tenant, firm, corporation, and/or other occupant of the property from which the ice or snow originated shall be jointly and severally liable to repay the City of Bangor all reasonable charges therefor. BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 234-12 of the Code of the City of Bangor be amended as follows: Any person guilty of a violation of any of the provisions of this chapter or amendments thereof to which a particular penalty is not annexed shall be punished by a fine not less than 100 $-2-0, and each day on which such violations continue shall constitute a separate offense. 18-317 AUGUST 13, 2018 Additions are underlined, deletions struea kt.
