The City has been working with representatives of Burns & McDonnell for approximately 18 years to develop methods to mitigate the coal tar contamination within the Penobscot River. This work is required a part of the City of Bangor Consent Decree with the State of Maine Department of Environmental Protection. Infrastructure Committee 08/06/2018 Recommend for passage 50 Burns & McDonnell Agreement Consent 08/13/201818-311 CITY OF BANGOR ORDER 08/13/2018 18-311 Nichols Authorizing Execution of Contract with Burns and McDonnell for Remediation of Secondary Active Zone within the Penobscot River WHEREAS, On June 5, 2007 a Consent Decree was entered in the case of City of Bangor v. Citizens Communications Company providing for remediation of the coal tar in the Penobscot River; and WHEREAS, statutory and regulatory requirements for amendment to the Consent Decree required that there be additional studies of the remaining contamination area; WHEREAS, On September 13, 2017 work was performed for the remediation of the shallow portion of the Secondary Active Zone (SAZ) to construct a Sediment Cap; WHEREAS, additional studies are required for post monitoring of the new sediment cap in the Secondary Active Zone (SAZ); and WHEREAS, Submission of an Explanation of Significant Difference Report be submitted to the Department of Environmental Protection for the Inactive Zone (IZ) for future remediation. Be it Ordered by the City Council of the City of Bangor that, The City Manager is hereby authorized to execute a contract with Burns & McDonnell for SAZ Post Construction Monitoring and Preparation and Submission of an Explanation of Significant Difference Report for the Inactive Zone to DEP. 18-311 08/13/2018 July 24, 2018 Mr. John Theriault City Engineer City of Bangor 73 Harlow Street, Bangor, ME 04401 Re: Engineering Proposal Bangor Landing Sediment Dear Mr. Theriault: Burns & McDonnell Engineering Company, Inc. (Burns & McDonnell) is pleased to provide the City of Bangor (the City) with this agreement for environmental services to be provided on the referenced project as follows: PROJECT Burns & McDonnell and the City agree that Burns & McDonnell will provide professional services described herein in accordance with and subject to the terms and conditions set forth in the Master Services Agreement between Burns & McDonnell and the City, dated March 1, 2012. Bangor Landing Sediment Remediation Studies — Work Authorization SAZ Post -Construction Monitoring and Preparation of an ESD for the Inactive Zone Objective: 0 To monitor performance of the sediment caps over the PAZ and shallow SAZ and prepare an Explanation of Significant Differences Report for the Inactive Zone Scope of Services: Task 1— Post -Construction Monitoring 0 Perform post -construction monitoring for PAZ and SAZ, (2 monitoring events, each three days long) for the sediment caps in Dunnett's Cove, and 0 Prepare a monitoring report for submittal to the DEP. Estimated Cost: SOf South)Pasa Baad • Madison, W153719 Tek 6084304961 • www.harnsmrd.ram 18-311 08/13/2018 N Mr. John Theriault July 24, 2018 Page 2 • Labor and Expenses Assumptions: $ 60,000 • Ebullition monitoring will require three days in the field for five staff (two Burns & McDonnell, three SW Cole) during two mobilizations (one in August, one in September or October). • Field work will be performed in fair weather. • The monitoring report will be approved without substantial modifications by the MEDEP. Task 2 - Hydrographic Survey • Perform a hydrographic survey to document the post -construction conditions for the SAZ sediment cap for submittal to the USACE. • Submit the map to the USACOE and MEDEP. Estimated Cost: Assumptions: $ 22,000 • Field work will be performed in fair weather. • Results of the survey will be submitted to the USACOE in a brief letter report. Task 3 - Preparation of an ESD Report for the IZ • Prepare an ESD Report for the IZ based on existing information. Estimated Cost: • Labor and Expenses Assumptions: $ 40,000 • The ESD report will require two drafts before being accepted by the MEDEP. It is estimated that the ESD report will require about 120 hours of associate scientist time, 60 hours of assistant scientist time, and 20 hours of drafting. 18-311 08/13/2018 N Mr. John Theriault July 24, 2018 Page 3 Task 5 — Regulatory Negotiation Assist the City with negotiation of the ESD with the MEDEP Estimated Cost: Labor and Expenses Assumptions: $ 25,000 • Regulatory negotiation will require an estimated 80 hours of associate scientist time, 80 hours of assistant scientist time, and 20 hours of drafting. • Regulatory negotiation will require two trips to Maine to meet with the City and the MEDEP. Task 6 — Project Management Perform project management functions such as financial management and quality control. Estimated Cost: • Labor and Expenses $ 12,000 Assumptions: • Project management will require about 8% of labor hours Estimated Cost: COMPENSATION A. Amount of Payment For the Scope of Services described herein, the City shall pay Burns & McDonnell on a time - and -materials basis. Burns & McDonnell estimates that our fee for these services will be $159,000. B. Invoices Monthly invoices will be submitted by Burns & McDonnell to the City. Invoices will be based on Burns & McDonnell's time and materials expenditures for the preceding month.
