Commentary:
This Order contains the City Engineer's report describing the
discontinuance of Water Street between Broad Street and Kenduakeag
Plaza to accommodate the construction of the new parking garage.
A publicaent will be retained to permit traffic to pas through
the garage between Broad Street and Kenduskeag Plaza and to maintain
existing underground utilities.
The Councillor attention is directed to the need to relocate the
Casco Northern Bank drive-in entrance from Water Street to Kenduakeag
Plaza, and to provide a temporary entrance to the bank from Broad
Street during construction, to be done by the City at an estimated
coat of $3,000.00.

ORDERED,
THAT the attached report of the City Engineer relative to the discon-
tinuance of Water Street for street purposes between Broad Street and Kenduskeag
Plaza be and hereby is accepted; and be it further
ORDERED,
TDAT said portion of Water Street be discontinued for street purposes,
retaining a public easement for the construction of a parking garage and
for existing underground utilities: and be is further
THAT the sum
of Three Thousand Dollars ($3,000.00) be authorized for the
relocation of theentrance to the Casco Northern Bank from Water Street to
Kenduskeag Plaza, and for the construction of a temporary entrance to the bank
property from Broad Street, said funds to be taken from the parking garage
construction account.

Beginning at the intersection of the southerly right-of-way line
of Water Street with the easterly right-of-way line of Broad Street;
thence South 80° 08' 30" East along said southerly right-of-way, line of
Broad Street for a distance of eleven and eight one hundredths (11.08)
feet to a paint; thence continuing along said southerly right-of-way,
line of Fater Street North I3° 49' 50" East for a distance of one hundred
twenty and eighteen one hundredths (120.18) feet to a point an the westerly
Sim of Kenduskeag Plaza, asestablished by a layout and taking of the
City Council of the City of Bangor by Council Order No. 239-N passed
October 9, 1961; thence March 12° 26' 40" West along said westerly line
of Kenduskeag Plaza for a distance of sixty and thirteen one hundredths
(60.13) feet to a point, being at the intersection of said westerly line
of Kenduskeag Plaza with the northerly right-of-way line of water Street;
thence South 73° 49' 50" West along said northerly right-of-way line of
Water Street for a distance of one hundred ten and twenty -mea hundredths
(110.21) feet t a point; thence continuing along said northerly right-of-way
line of Water Street North SV 08' 30" West for a distance of twenty-three
and eighty-one one hundredths (23.81) fear to the easterly right-of-way
line of Broad Street; thence South 14° OL 40" East along the easterly
right-of-way line of Broad Street for a distance of sixty-five and sixty-

or per appeared at the time and place set for the
hearing; however. Mr. Kenneth Hensler and Mr. Roger Hunter, representing
the Casco Northern Bank which abuts the southerly side of Water Street,
met with the City Engineer on March 18, 1988 to determine the effect of
the proposed discontinuance on their facility. The City Engineer advised
them that the right-of-way would continue to be kept open for through
traffic between Broad Street and Kenduskmg Plaza, but that the primary
use of the right-of-way would be for the erection of a parking garage
with part of the garage structure to occupy pardons of the existing
right-of-way. Existing underground utilities wouldalso z main In place.
The greatest impact on their property as a result of the discontinuance
and garage construction is the necessity t relocate their existing
driveway entrance from Water Street to the easterly side of their property,
connecting to Kenduskeag Plaza. The City Engineer indicated to them that
hewould Zoend that in lieu of damages for the discontinuance. the
City would pay for and would construct the relocation of their driveway.
They also expressed thenn that Water Street would be closed
off completely to through traffic during the period of construction,
probably lasting through the end of this year, which would make access
to their property more difficult, since most of the traffic approaches
the drive-in bank in an eastbound direction on Water Street. The City
Engine suggested that a temporary driveway entrance would be onstructed
on a 50 -foot wide strip of land awned by the City which borders the south
side of their property, which would provide temporary as s during the
period. of construction. The City Engineer also indicated that he would
recommend to the City Council that the City install and pay for the
temporary access.

The total estimated coat of the permanent driveway entrance relocation
to Renduakeag Plaza, and the temporary driveway entrance from Broad Street,
is $3,000.00.
It is recommended that the above described portion of Water Street
be discontinuedtfstreet purposes.
