WHEREAS, the High Density Residentail Zoning District will allow the applicant to proceed with the development of multi -family housing Chapter 165 of the Code of the City of Bangor is amended as follows: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT That the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing a parcels of land located at 45 and 59 Hogan Road (Tax Map R71 Parcels 011, 012, and 013) from Low Density Residential District (LDR) to High Density Residential District (HDR) Said parcel of land containing approximately 4.19 acres and being more particularly indicated on the map attached hereto and made a part hereof. 3 C 1 SD M 4p,• MUM 18-296 JULY 23, 2018 W01 in t o' Ab MEMORANDUM DATE: August 8, 2017 TO: The Honorable City Council FROM: David G. Gould, Planning Officer SUBJECT: Amending Zoning Ordinance 45 & 59 Hogan Rd — Low Density Residential (LDR) to High Density Residential (HDR) — Council Ordinance 18-296 Please be advised that the Planning Board at its meeting on August 7, 2018, held a Public Hearing on the above zone change request. Chairman Charles Boothby asked the applicant or their representative to make a brief presentation of the request. Mr. Fred Marshall of Plymouth Engineering indicated that he was representing the applicant, Canoe Creek, LLC. Mr. Marshall reviewed the details of the Comprehensive Plan and the rezoning application's consistency with the Plan. He noted that the surrounding area has changed greatly over time and that this property is shown in the comp plan as an area for increased residential density. The applicant has no concrete plans for the site at this time, due to difficulties accessing public sewer, however they are interested in exploring the option. Chair Boothby asked for public comment on the proposed zone change. Sylvia Dyer of 73 Hogan Road expressed her concern about traffic impacts if a significant number of housing units were able to be added in this area. She stated that it was extremely difficult for her to enter & exit her property under current conditions. Daniel Fowler of 95 Hogan Road also spoke in opposition to the proposal, stated that he had lived in this neighborhood his entire life and was surprised to hear that it could be changed so dramatically. He stated that he was concerned about how a large residential complex might impact his property value. Planning Officer Gould provided his staff report, stating that this area has been identified for increased density since the 1979 Comprehensive Plan. He noted that while the rest of the mall area has changed significantly over time, this area has not, likely due to limited access to public sewer. He pointed out that adjacent areas on State Street have increased in density significantly over the same period. Member Huhn made a motion that the Planning Board recommend the City Council adopt C.O. 18-296, amending the zoning at 54 & 51 Hogan Road from Low Density Residential (LDR) to High Density Residential (HDR), Canoe Creek LLC, applicant. Member Durgin seconded the motion. The Planning Board voted unanimously in favor to recommend C.O. 18-296.
