ORDERED,
THAT WHEREAS, the City Council by passage of Council Order 87-
381 on October 13, 1987 designated Eaton, Peabody, Bradford and
Veague, P.A. as tentative developer of Urban Renewal Parcel B-13 for
a period of ninety (90) days during which time the Legal Department,
in consultation with the Community Development Committee and the
Director of Planning and Community Development, was authorized t0
negotiate an Option Agreement with Eaton, Peabody, Bradford and
Veague, P.A. for future consideration by the City Councilt and
WHEREAS, anextention of tentative developer status t0
February 17, 1988 was granted by the City Council passage of Council
Order 88-75 on January 1. 1988; and
WHEREAS, conditions relating to parking, public
improvements and an Urban Development Action Grant proposed by both
parties have required additional time for consideration before
inclusion in a proposed option agreement; and
WHEREAS, several discussions and meetings between the
City staff, the tentative developer and representatives of the U.S.
Department of Housing and Urban Development - Urban Development
Action Grant staff have not yet resulted in resolving the most
beneficial terms and conditions under which an Urban Development
Action Grant should be applied for and which would have to be
included in the terms and conditions of an Option Agreement; and
WHEREAS, recognizing that the City Council has granted
extention to February 17, 1988 with the expectation that such issues
would be resolved, the Director of Planning and Community
Development has requested a further extention to March 31st, the
ext deadline for filing an application for Urban Development Action
Grant (UDAG) funds by which time all of the considerations involved
will have to be resolved; and

WHEREAS, the request for the extortion is not asresult
of lack of progress on the pant of the tentative developer but
is
for the purpose of structuring the terms and conditions incorporated
into an application for Urban Development Action Grant funds in such
way that they will maximize the benefit to both the City and the
tentative developer;
NOW, THEREFORE, BE IT ORDERED THAT the tentative
developer status granted Eaton, Peabody, Bradford and Veague, P.A.
for Urban Renewal Parcel B-13 is hereby extended to March 31, 1988.
