Authorizing the City Manager to Execute a Permit with Half Acre, Inc. to Allow an Outdoor Seating Area on
City Property
This Order would authorize the City Manager to execute a seating permit with Half Acre, Inc. to have
an outdoor seating area behind its building at 190 Harlow Street. The area, along with a structure
attached to the building, would extend into the City's Lower Abbott parking lot. The structure will
need approval for design review purposes by the City's Historic Preservation Commission.
A number of concerns about the proposed seating area were raised at the Business and Economic
Development Committee meeting on June 20. These concerns primarily related to noise and trash.
Under the terms of the proposed outdoor seating permit, alcohol service and consumption would
have to stop by midnight. The City would also require an employee to be stationed outside while the
seating area is being used. Half Acre would be responsible to ensure that the area is clear of trash.

WHEREAS, Half Acre, Inc. wishes to have an outdoor seating area behind its building at 190 Harlow Street;
and
WHEREAS, the outdoor seating area, along with a structure attached to the building, would extend into the
City's Lower Abbott parking lot;
Be it Ordered by the City Council of the City of Bangor that,
The City Manager is hereby authorized to execute a permit with Half Acre, Inc. allowing an outdoor seating
area and associated structure on City property behind 190 Harlow Street, in final form as approved by the City
Solicitor or Assistant City Solicitor. The permit shall include a provision requiring a Half Acre employee to be
stationed at the outdoor seating area while it is in use.

MOTION MADE AND SECONDED FOR PASSAGE
DAVID CASE, PRESIDENT OF THE ASSOCIATION AT 112 FRANKLIN PLACE,
SPOKE AGAINST THIS MOTION AND FELT IT WOULD MAKE MATTERS WORSE.
BILL PHILLIIPS, FRANKLIN PLACE SPOKE AGAINST THE MOTION AND ASKED IF THERE
WAS SOME WAY OF DISCOURAGING PEOPLE FROM CONGREGATING IN THE PARKING LOT.
DIANA YOUNG, ALLEN COURT, STATED KENDUSKEAG STREAM IS A NOISE FUNNEL.
JANICE PILOTTE, COURT STREET, STATED SHE COULD HEAR THE NOISE ON COURT STREET. SHE ALSO SAID
THE POLICE HAVE DONE A REMARKABLE JOB ALL YEAR LONG.
PATRICK BRANN, OWNER OF HALF ACRE, STATED IT IS MORE THAN THE PATRONS OF HIS BUSINESS THAT USE THE
PARKING LOT. HE SAID THE PATIO WAS NOT THE NOISE PROBLEM, IT IS WHEN PEOPLE LINGER OUTSIDE' THAT IS THE ISSUE.
HE SAID THE PATIO HOLDS 3 TABLES AND THEY WILL NOT BE SERVING ALCOHOL OUTSIDE. PATRONS CAN TAKE THIER DRINK
OUT BUT THERE WILL BE NO SERVER.
MATT BRANN APPRECIATED THE FULL THOUGHT THAT WENT INTO THIS. HE FELT MEETING WITH THE NEIGHBORS WOULD BE A GOOD IDEA
AS THEY WERE NOT AWARE OF SOME OF THE PROBLEMS.
CATHERINE COLLINS SAID THERE IS VERY LITTLE NOISE AND FEW CARS SUNDAY THROUGH WEDNESDAY.
EILEEN HODGES STATED SHE LIKES TO KEEP HER WINDOWS OPEN BUT CAN'T ON THE WEEKEND.
