HomeMy WebLinkAbout2018-06-11 18-236 Order 06/11/201818-236 06/11/2018 18-236 Community & Economic Development Order 100-006 Title, Order Consent to Sublease between R & B Properties, LLC and VERSUS Entertainment LLC at 366 Griffin Road (Map 100, Lot 006) This order will authorize R & B Properties, LLC a consent to sublease a building at 366 Griffin Rd., Bangor (Lot No. 10, BIA Commercial / Industrial Park) to VERSUS Entertainment, which will use the facility for a similar purpose. R & B Properties, LLC recently purchased the building at 366 Griffin Rd. from USABFIT, LLC. The lease of the land parcel with the City of Bangor runs through 2021 with three (3) additional options of five (5) years each which could extend the lease through 2036. The sublease must be approved by the City of Bangor. A sublease will not relieve R & B Properties, LLC from any of the responsibilities or obligations of the lease. Finance Committee 06/04/2018 Recommend for passage Staff recommends approval Consent 06/11/201818-236 CITY OF BANGOR ORDER 06/11/2018 18-236 Nealley Consent to Sublease between R & B Properties, LLC and VERSUS Entertainment LLC at 366 Griffin Road (Map 100, Lot 006) WHEREAS, the City of Bangor is the owner of Lot 10 in the BIA Commercial / Industrial Park, 366 Griffin Road; and WHEREAS, by virtue of an Indenture of Lease dated October 8, 2015 USABFIT, LLC leased Lot 10 in the BIA Commercial / Industrial Park from the City of Bangor; and WHEREAS, USABFIT, LLC assigned the Indenture of Lease between the City of Bangor and USABFIT, LLC to R & B Properties, LLC on March 28, 2018; and WHEREAS, said Indenture of Lease provides that the tenant may not sublet any portion of the premises without the express consent of the City of Bangor; and WHEREAS, R & B Properties, LLC wishes to sublet the building to VERSUS Entertainment LLC: Be it Ordered by the City Council of the City of Bangor that, Catherine M. Conlow, City Manager, is hereby authorized to execute a Consent To Sublease to VERSUS Entertainment LLC by R & B Properties, LLC for the building on Lot 10 in the BIA Commercial / Industrial Park.
