This parcel was zoned to allow medical offices in 1984. A larger medical complex was proposed in 1994 on 10.25 acres adjoining this parcel. The proposed project never came to fruition. The proposed change in contract conditions would allow for business and professional office use in addition to the existing medical office space. Traffic generated by a business or professional office is typically less than that generated by a medical office. The other contract conditions would remain the same. Committee Action Committee: Planning Board Action Staff Comments & Approvals Meeting Date: June 5, 2018 For: Against: City Manager City Solicitor Finance Director Introduced for: First Reading and Referral CITY COUNCIL ORDINANCE Date: May 30, 2018 Assigned to Councilor: Davitt 18-213 5/30/2018 ORDINANCE, Amending Chapter 165, Land Development Code, by Making a Contract Zone Change - 498 Essex Street - Contract Government and Institutional Service District (G&ISD) to Contract Urban Service District (USD) WHEREAS, 498 Essex Street is presently zoned contract Government and Institutional Service District, allowing for medical offices; WHEREAS, the applicant desires to use some of the existing medical office space at 498 Essex Street as professional or business office space; WHEREAS, the traffic generated by a professional or business office is typically less than that for a medical office per square foot; and WHEREAS, the remainder of the original contract conditions will remain the same. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor is amended as follows: That the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing the parcel of land located at 498 Essex Street (Tax Map No. 45 parcel 11) from Contract Government and Institutional Service District (G&ISD) to Contract Urban Service District (USD), said parcel portions containing approximately 5.4 acres, and shown on the map attached hereto and made a part hereof. PROVIDED, HOWEVER THAT, in addition to the mandatory conditions imposed by Chapter 165-7 of the Ordinances of the City of Bangor, said change of zone is granted subject to the following limitations and/or restrictions: 1. Uses on the site shall be limited to Clinics (medical or dental) and professional or business offices. 2. All buffer yards adjacent to residential districts which parallel Essex Street will be a "B" with a minimum width of twenty (20) feet. 3. Development within the portion of the site bounded by Essex Street and extending one hundred and five feet (105 perpendicular back from the Essex Street Right—of-Way line will be limited to the existing areas drive.
