Authorizing Execution of Modification 1 to Agreement for Maine Department of Transportation Local Project -
WIN 20896.00, Union Street (Route 222) and 14th Street.
Summary
This order will authorize the City Manager to execute Modification #1 Agreement with the Maine
Department of Transportation for intersection improvements to Union Street and Fourteenth Street
for additional funding.
On April 25, 2016 under Council Order # 16-159, the City Manager was authorized to enter into an
agreement for design of the replacement of traffic signals at the intersection of Union Street (Route
222) and Fourteenth Street and construction of a right -turn lane from Fourteenth Street onto Union
Street.
Modification #1 would increase the funding by $7,135.00 bringing the total project cost to
$248,000.00. The total State/Federal share of 90% is equal to $$223,200.00 and the Municipality
share of 10% is equal to $$24,800.00. As a condition of this funding, the City is required to enter
into a Local Project Agreement with the Maine Department of Transportation.

This Modification 1 shall apply to an Agreement with the City of Bangor for intersection
improvements that took effect May 13, 2016. This modification, when executed, will increase
the Agreement by $7,135 - to a new total of $248,000 - to meet the latest estimate for the
Project, as follows:
ARTICLE 1 - PROJECT OVERVIEW
Section 1 B, "FUNDING," shall be modified to read as follows: BACTS programmed two
hundred forty-eight thousand dollars ($248,000.00) for the Project to be shared as set forth in
Article 3, "Financial Provisions." Project costs exceeding this amount shall require approval
from BACTS and MaineDOT to be eligible for state and federal funding.
ARTICLE 3 - FINANCIAL PROVISIONS
Section 3A, "MAINEDOT SHARE," shall be modified to read as follows: MaineDOT, using
federal and state funding programmed by BACTS, will share in the cost of the Project at the
rate of ninety percent (90%), up to a maximum of two hundred twenty-three thousand two
hundred dollars ($223,200.00).
Section 3B, "LOCAL SHARE," shall be modified to read as follows: The City shall share in the
cost of the Project at the rate of ten percent (10%), or an estimated contribution of twenty-four
thousand eight hundred dollars ($24,800.00.) Furthermore, the City shall be fully responsible
for expenditures:
1. Incurred before the date of Notice to Proceed;
2. Deemed ineligible for federal financial participation; and
3. Exceeding the upset limit of this Agreement, as set forth in Section 1 B, "Funding."

All other terms and conditions of the original Agreement shall remain in place with no gap.
MaineDOT and the City of Bangor, by their duly authorized representatives, have executed
this latest modification to the original Agreement on the date last signed below.
