Summary
This Order will authorize the City Manager to execute a Local Project Agreement Modification #2
with the Maine Department of Transportation to provide additional funding for intersection
improvements at Ohio Street and Fourteenth Street.
On August 28, 2017 under Council Order #17-306, the City Manager was authorized to enter into an
agreement for design of the replacement of traffic signals, installation of pedestrian signals,
rehabilitation of sidewalks and sidewalk ramps, and adjustment of the turning radius.
Modification #2 would increase the funding by $11,062.50 bringing the total project cost to
$222,000. Additionally, it would modify the contract to reflect the State/Federal share of 90% or
$199,800.00 and the City's share of 10% or $22,200.00.

This Modification 2 shall apply to an Agreement with the City of Bangor that was executed on
May 13, 2016 and was modified previously on September 13, 2017. This modification, when
executed, will increase the Agreement by $11,062.50 - to a new total of $222,000 - to reflect
the latest estimate for the Project, as shown below:
ARTICLE 1 - PROJECT OVERVIEW
Section 1 B, "FUNDING," shall be modified to read as follows: BACTS programmed two
hundred twenty-two thousand dollars ($222,000.00) for the Project to be shared as set forth in
Article 3, "Financial Provisions." Project costs exceeding this amount shall require approval
from BACTS and MaineDOT to be eligible for state and federal funding.
ARTICLE 3 - FINANCIAL PROVISIONS
Section 3A, "MAINEDOT SHARE," shall be modified to read as follows: MaineDOT, using
federal and state funding programmed by BACTS, will share in the cost of the Project at the
rate of ninety percent (90%), up to a maximum of one hundred ninety-nine thousand eight
hundred dollars ($199,800.00).
Section 3B, "LOCAL SHARE," shall be modified to read as follows: The City shall share in all
federally eligible Project costs at the rate of ten percent (10%), or an estimated twenty-two
thousand two hundred dollars ($22,200.00). Furthermore, the City shall be fully responsible for
expenditures:
1. Incurred before the date of Notice to Proceed;
2. Deemed ineligible for federal financial participation; and
3. Exceeding the upset limit of this Agreement, as set forth in Section 1 B, "Funding."

All other terms and conditions of the original Agreement shall remain in place with no gap.
MaineDOT and the City of Bangor, by their duly authorized representatives, have executed
this latest modification to the original Agreement on the date last signed below.
