And that the said City Engineer met at the time and piece of martimg ape dfled be bas nodame and proceeded to hay NNN disconrime. ;d p cioq of F b Street f ll -2- Beginning at a point on the easterly right-of-way line of French Street located 715 feet north from the northerly right-of-way line of Congress Street, being the northerly tensions of a portion of French Street which was previously discontinued by the Bangor City Council by Council Order No. 87-320 passed August 24, 1987; thence in a northerly direction along said easterly right-of-way line of French Street for a distance of 329.58 feet to the intersection with the northerly line of land owed by the M d J Company, as described in a Deed recorded in Penobscot Registry of Deeds in Vol. 3447. Page 358; thence In westerly direction at right angles with the lest described line for a distance of 50 feet to the westerly right-of-way line of French Street; thence in a southerly direction along the westerly right-of-way line of French Street for a distance of 329.58 feet to a point to the northerly terminus of that portion of French Street previously discontinued; thence in an easterly direction for a distance of 50 feet to the paint of beginning. There appeared at the time and place set for the meeting Mr. Charles Wellman and Mr. Thomas Russell, Esquire, representing St. Joseph Mealtbcare Foundation, the original petitioners for the discontinuance, who spoke in favor of the discontinuance as proposed. Mr. Russell also indicated that St. Joseph Healthcare Foundation would waive its rights to any damages as notcult of said discontinuance. The City Engineer indicated that he would recommend that any damages be paid as a result of said discontinuance. Inasmuch as St. Joseph Healthcare Foundation, or its subsidiaries, owes all of the land abutting the proposed portion of French Street to be discontinued, and since that portion of French Street would e further public need, it is recommended that It be discontinued and removed from the Official City Hap, subject to the reservation of an easement for any existing public utilities. The Planning Board has previously taken the necessary action to remove this portion of French Street from the Official City Map. Respectfully submitted, John T. Frawley, City En sneer -3-
