Summary
This ordinance will amend Chapter 165 of the Land Development Code by rezoning 61 Cumberland Street from
Contract Urban Service District (USD) to Government and Institutional Service District (G&ISD). In the past,
the building located at 61 Cumberland Street had been granted a contract USD zone and used for retail sales.
Recently, the property changed ownership and the new owner seeks to return the use to a place of worship.
If approved, the zone change will return the property to the Government and Institutional Service District
(G&ISD), which allows for places of worship and other nonprofit facilities, consistent with G&ISD.

ORDINANCE, Amending Chapter 165, Land Development Code, By Rezoning 61 Cumberland Street from
Contract Urban Service District (USD) to Government and Institutional Service District (G&ISD)
WHEREAS, the property located at 61 Cumberland Street is presently zoned for a retail floral shop; and
WHEREAS, the existing building was formerly a church and the new owner seeks to return it to a place of
worship.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
The zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991 as
amended, be hereby further amended as follows:
By changing a parcel of land located at 61 Cumberland Street (Tax Map 40 Lot 95) from Contract Urban
Service District (USD) to Government and Institutional Service District (G&ISD). Said parcel containing
approximately 8, 712 square feet and being more particularly indicated on the map attached hereto and made
a part hereof.

Please be advised that the Planning Board at its meeting on April 3,2018,held a
Public Hearing on the above zone change request.
Chairman Charles Boothby asked the applicant or their representative to make a
briefpresentation of the request.
Mr. Alan Kochis Business Manager for the Bangor School Departmentindicated
that the school started using the existing building at the Airport Four years earlier and
had seen a large increase in the number of students entering the program, Southern
Penobscot Program for Children with Exceptionalities (SPRUCE).
The program started with 35 students and grew to 45 in two years. Currently
with 50 studentanticipated for the fallof 2018 a second portableis warranted. As the
program expands it would good to plan for a permanent building instead of the current
portableclassrooms.
There were no opponents to the rezoning request.
Member Brush asked about the proximity of the existing buildings to one
another. Mr. Kochis responded that the two currently buildings are directly adjacent to
one another.
There was no additional comment or discussion. Chair Boothby Closed the Public
Hearing.
Member Durgin moved to recommend the proposed zone change to the City
Council. Member Huhn seconded the motion. The motion passed unanimously in favor
torecommend C. O. #18-0160.
