Approving the Final Plat - Bolduc Property Subdivision

Comm vtary:
The Planning Board held a public hearing on the above -noted
final subdivision plan at its regularly scheduled meeting of
November 6, 1989.
No one spoke in opposition to this request.
The Planning Board voted 5 to 0 in favor of a motion to approve
the final subdivision plan with the condition that an agreement
be executed and in satisfactory form with the City Solicitor
regarding the construction and maintenance of the proposed
private street.. _
NOTE: This final subdivision plan is for a three -lot subdivision
located at approximately 1200V Ohio Street.

ORDERRD,
TEAT the final subdivision plan for a three -lot subdivision
located at approximately 1200V Ohio Street, havingg been reviewed by
the Planning Board and found to be in general conformancewith local
subdivision laws and State of. Maine Statutes, Title 30, Section 4956,
be approved. No public improvements are proposed, therefore, no bond
required.
AND HE IT FURTHER ORDERED THAT, the City Manager be hereby
authorized toexecute a Road Agreement between the City and the property
owner regarding the construction and maintenance of the proposed private
street, a copy of which being on file in the City Clerk's Office.

a. Applicant requests final subdivision plan approval for a 3
lot subdivision located at 1200 Ohio Street in a Residential
----4 -Zone.

It. The proposed subdivision received preliminary plan approval
with the condition that the City Engineer's Office approves
the design of the proposed private street.
c. The Subdivision Ordinance requires that applicants proposing
a private street submit documentation as to who will be
responsible for construction and maintenance of the roadway.
At the time of this memorandum the City Engineer's Office is
still reviewing the construction details and no documenta-
tion has been submitted concerning the private street.
d. Staff would not recommend final subdivision approval until
the City Engineer''% Office approves the construction details
and that applicant provides the City's Legal Office with the
details for the construction and Operation of the private
street.
