The Planning Board held a public hearing on November 20, 1989 at its
regularly scheduled meeting. The action on the item was tabled to the
next meeting to provide time for further review of the proposed action.
The Planning Board continued the public hearing at its regular meeting
of December 4, 1989. At that meeting an amendment to the order was
Presented which deleted a small area from the .original change in the
vicinity of Kittredge Road and Stillwater Avenue. This amendment also
added language.which would provide the basis for dealing with any zone
changes in that area which was.deleted from the original order.
There were a'number of opponents to the proposed Land Use Plan amendmen
including Attorney P. Andrew Hamilton, representing a propertye r on

Stillwater Avenue, Attorney Nathan Dane, representing the owner of
property betind properties on Stillwater Avenue, and comments from ten
persona who had property in the affected area or who were somewhere
related to owners of property in, the area.

ORDERED,
THAT WHEREAS, the Bangor City Council adopted the present
Comprehensive Plan of the City of Bangor, Maine by Council Order 50 AB
on January 28, 1974 and the Bangor City Council amended said Compre-
hensive Plan by the adoption of the revised Land Use Plan by Council. Order
150 AG on June 11, 1979; and
THAT, in addition to the deletion of areas identified on the
attached amended map from "Coum;ercial" and "High Density Residential"
acategories the area presently proposed for future commercial use
in the apex of the triangle formed by the junction of Kittredge Road
and Stillwater Avenue, while indicated for potential future commercial
use, should not be considered for development or commercial zoning until
afull range of City services are available in this area and arterial
street capacity has been increased to handle Mall area traffic.
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY
OF BANGOR THAT, the proposed revision to the 1979 Land Use Plan for the
area west of Stillwater Avenue in thevicinity of Bangor Mall, Gilman
Road, and Hogan Road be adopted by changing certain areas proposed for
High Density Residential Use and Commercial Use to Agricultural Use in
accordance with the attached exhibit..

After extensive discussion about the implications of changing the long
standing land use policyin this area, the Planning Board voted
to -0 against recommending the land use amendment to the City Council.
This amendment to the City's Land Use Plan would remove approximately
130 acres of land presently proposed for commercial or high density
esidential use In the area northwest of Stillwater Avenue which isanoutgrowth of the recommendations made in the analysis of present
trends in the Mall Area submitted to the Comprehensive Plan Committee
as part of the review.

THAT WHEREAS, the Bangor City Council adopted the present
Comprehensive Plan of the City of Bangor, Maine by Council Order 50 AS
on January 28, 1974 and the Bangor City Council amended said Compre-
hensive Plan by the adoption of a revised Land Use Plan by Council Order
150AG on June 11, 19791 and
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY
OF BANGOR THAT, the proposed revision to the 1979 Land Use Plan for the
area west of Stillwater Avenue in the vicinity of Bangor Mall, Gilman
Road, and Hogan Road be adopted by ;changing certain areas proposed for
High Density Residential Use and Commercial Use to Agricultural Use in
accordance with the attached exhibit.

The attached order contains a proposed amendment to the City's Land
Use Plan in the Mall area.
This order is in response to the study of the current conditions of
the Mall area initiated under the -moratorium established in this
area by the Council in July of this year. Me proposed order
would reduce the amount of presently. zoned Agricultural areas
which are proposed for commercial and high density residential use
in this area.
This order must go to the Planning Board for a public hearing prior
to action by the City Council.

Possible alternative to changing all of the areas indicated
on the exhibit, primerily,to deal with the area between
Kittredge Road and Stillwater Ave., where a number of land
owners have raised questions about what the City's ultimate
intent would be for development policy in this area. At-
tached is language whin would be added to the proposed
amendment which would clarify the future of this triangular
area which is in such close proximity to presently developed
areas on an as and Stillwater Ave. What this would
provide is that this area would remain on the Land Use Plan,
but would clearly not be eligible for rezoning or develop-
ment in the near future or until such time as the provision
Of services and the adequacy of arterial street capacity in
this Mall area is assured.
b. we would recommend that the Planning Board recommend the
Land Use Plan amendment as amended to the City Council.
