Inc, of allew¢h. Since all work has been satisfactorily completed and the streets and sewers are ready for acceptance, this report Is being submitted to the - Council forfinal action. ORDERED, THAT , waSphe S, the streets and sewers in the Prentiss woods Subdivision n Essex Street, constructed by Devote, Inc. of Ellsworth, Save been satisfactorily constructed to acceptable City standards; and WHEREAS, It has been previously agreed by the City Council that the City will reimburse fifty percent of the estimated cost of the sanitary sewer Instal- lation, to be pro rated against each of the Lotsbenefitted, said reimbursement to be paid at such time as each Lot is developed and a Certificate of Occupancy is issued; and WHEREAS, the total estimated cost of the sanitary sewers as outlined in the attached report of the City Engineer is $80,780.00; and WHEREAS, a total of twenty-five (2j) Lots in the Subdivision, and one (1) additional property on Essex Street are benefitted by the sewer installation; NOW, THEREVORE, Be It ORDERED, THAT the Finance Director be and hereby is authorized to reimburse the. Developer. Durban. Inc. of Ellsworth, fifty percent of the estimated sanitary sewer co, pro rated against the Lots benefitted as described in the attached report ofst the City Engineer, the reimbursement for each Lot to be paid at such time as the Code Enforcement Officer Issue, a Certificate of Occupancy for said Lot( and be it further ORDERED. THAT the funds for said sewer reimbursement be taken from the Reserve for Future Construction - Sewer Account, Account No. 92-2236. Councilman CITY OF BANNON, MANS Engineering Department To the Municipal Officers: October 17, 1989 Reference is made to City Council Order No. 88-88 passed January 25, 1988 which approved the final Plat of the Darbro Subdivision located o Essex Street north of Grandview Avenue, as submitted by Darbro, Inc. of Ellsworth, the Developers. ALL work in the Subdivision has been satlafaccozily completed, including the construction of Greenfield Avenue extending west from Essex Street for a distance of approximately 400 feet, and Inheres lane extending in a southerly direction from the end of Greenfield Avenue for a distance of 713 feet to a cul-de-sac. Also installed m sewer facilities Including four catch e basins and storm sewer pipe outlets, an8inch water line, and a total of 2,110 feet of 8 inch sanitary seaand a manholes. A total of twenty- five (25) n residential Lots are benefieted by the street eet and utility installation. and a existing Lot located at 913 Essex Street will potentially benefit by the installation of the sanitary sewer. The estimated cost of the sanitary sewer is broken down as follows: (1) On Essex Street. a total of $85 feet of 8 inch sewer r and 4 manholes were installed. extending in a southerly direction from Greenfield Avenue, ata total estimated cast of $37,140.00. The a [es lots 2. 8, 9. 10, 11, and 12 in the Subdivision, and the property at 913 Essex Street, or a total of seven Lots. The total cost per lot would therefore be $5,306.00. (2) 240 feet of 8 inch sewer was installed on Essex Street extending in a northerly direction ftom Greenfield Avenue at an estimated est of $8,640.00, which Serves Lots 1 and 2, o aoat per Lot of $4,320.00. (3) A sanitary sewer n Labarea Lane connected to the existing Arctic Brook Sewer consisted of the installation of 985 feet of 8 inch pipe and 3 manholes at a total estimated cost of $35.000.00. This sewer Lots 13 through 25, inclusive, or a total of 13 Lots, at a cost per Lo[ of $2,692.00. Lots 3 through 6 are served'by the existing Arctic Brook Sewer, for which assessments were previously paid. By City Council Order No. 87-388 passed October 13, 1987, the City Council placed aratorium on City participation in the coat of subdivision improvements; however, the Fissure Committee subsequently agreed, at a seting on July 14. 1988,to participate in fifty percent of the sanitary sewer Data in the subject Subdivision on the basis of the fact that the planning work for the Subdivision bad commenced before the start of the moratorium. Consequently, it is recommended that the City reimburse the Developer for fifty percent of theestimated Sever cost, pro ted against each of the Lots as described above, to be paid on each Lot at the time the Finance Director is notified by the Cade Enforcement Officer that a Certificate of Occupancy has been issued for the Lot, to be covered by a Subordinate Agreement to be recorded in the Penobscot Registry of Deeds covering the proposed method of reimbursement. It Is also recommended that a Subordinate Agreement relative, 89-420 to the benefit to the property at 913 Essex Street also be filed in the Penobscot Registry of Deeds, which would require payment of an assessment to enter the said a m assessment to be paid to Barbra. Inc., amounting to $2,653.00. Me total reimbursement by the City for fifty percent of the estimated awa cast when all of the Lots have been developed would amount to $37,737.00.
