Commentary:
This Council Order would provide for the fifty percent reirburaement of the
estimated coat of the cavitary s ommanded by the Finance Committee
on July 14. 1908, since the planning process for the Subdivision had begun
prior to the establishment of a moratorium on City participation on October
13. 1981.

THAT . WHEREAS. the Mt. Hope Estates Subdivision roads and sewers have
been satisfactorily const two red to acceptable City standards; and
WHEREAS, it bas been previously agreed by the City Council that the City
would reimburse fifty percent of the estimated cost of the sanitary sever
installation, to be pro rated against each of the Lots to be served, said
reimbursement to be paid at such time as each Lot is developed and a Certificate
of Occupancy is Issued; and
WHEREAS, the total estimated coat of the sanitary sewers as outlined in
the attached report of the City Engineer Is $32,572.00; and
WHEREAS, a total of seventeen (17) Lots are benefitted by the sewer.

NOW. THEREFORE, Be It
DUEREO. THAT the Finance Director be and hereby Is authorized to reimburse
the Developer. Dr. peace Aloupas of Bangor, the sea of Nine Hundred Fifty-eight
Dollars ($958.00) for each of the seventeen (17) Lots benefitted, to be paid at
such time as the Finance Director is notified by the Code Enforcement Officer
that a Certificate of Occupancy has been issued; and be it further
ORDERED. THAT the funds for said a reimbursement be taken from the
Reserve for Future Construction - Sewer Account. -

Reference is made to City Council Order No. 88-42 passed December 14,
1987 approving the Final Subdivision Plan for the Mount Haps Estates Sub-
division on Mount Haps Avenue, as submitted by Dr. Vance Alouple, the
Developer. All work in the Subdivision has been satisfactorily completed,
including the construction of Kira Drive extending north from Mount Hope
Avenue for a distance of 705 feet to a cul-de-sac, and the construction of
vanes Avenue, extending northeasterly from Kira Drive a distance of 570 feet
to the center of a cul -de -eat. Also included was the installation of an 8
inch water line, approximately 610 feet of 12 inch storm s and 4 .catch
basins, and the installation of 1,143 feet of 8 inch sanitarysewer and 5
maMolea. A total of seventeen (17) new residential Lots are benefitted by
the street and utility installation.
By City Council Order No. 87-388 passed October 13, 1987, the City
Council placed aratorium on City participation in the cost of subdivision
Improvements, however. the Finance Committee subsequently agreed, at a
meeting on July 14, 1988, to participate in fifty percent of the sanitary
sewer oats on the subject Subdivision on the basis of the fact that the
planning work for the subject Subdivision bad commenced before the start
of the moratorium.
The total estimated cost of the sanitary sewer installation is
$32,572.00, of which the City would reimburse fifty percent, or $16.286.00,
amounting to $958.00 for each of the seventeen Lots benefitted.
It is recommended that the sever reimbursements take effect at such
time as the Cade Enforcement Officer issues a Certificate of Occupancy on
the development of each Lot. to be covered by a Subordinate Agreement to be
recorded in the Penobscot Registry of Deeds covering the proposed method of
reimbursement. -
As -Built Plana of the Subdivision are on file in the City Engineer's
Office.
