THAT the attached report of the Acting City Engineer on the
layout of land fox the widening of Griffin Road between Ohio Street
and Union Street be and hereby is accepted. Me areas described by
metes and bounds are hereby established as public ways and the
damages recommended are hereby approved for payment; that the areas
described for slope easements and temporary grading easements are
accepted and established for the purposes set forth.

.. Description of Lend Taken for Right -of -Way Purposes
The following descriptions refer to parcels of land as shown
on Maine State Highway Commission Plan SHO File #10-147 Federal
Project R -AD -12(1), Sheet 1 of 7, Revision 2, dated July, 1962
Right of Way Map for the construction of Griffin Road, Ohio Street
and Davie Road (capehart Housing).
Propperty owned by Socony Mobil 011 Go., Inc. designated as
Parcel #1, more fully described as follows:
Beginning at the intersection of the easterly sideline of Union
Street and the southerly sideline of Griffin Road as now laid out;
thence northeast along the southerly sideline of Griffin Road a
distance of about 202 feet to the westerly property line of land
owned by Philip Shapiro; thence southeast along the westerly property
line of land owned by Philip Shapiro a distance of about 4 feet;
thence southwest on a line parallel to and 4 feet distant from the
southerly line of Griffin Road as now laid out a distance of about
202 feet to the easterly sideline of Union Street; thence northwest
along the easterly sideline of Union Street a distance of about
4 feet to the point of beginning. The above described area contains
approximately 803 square feet, or .019 acres.

Relocation of light pole, sign pole
and portion of fence 550.00

Property owned by Philip Shapiro, designated as Parcel #2,
more fully described as follows:
Beginning at a point on the southerly sideline of Griffin Road
as now laid out, about 202 feet east of the intersection of the
easterly sideline of Union Street and the southerly sideline of
Griffin Road; thence northeast along the southerly sideline of
Griffin Road about 598 feet to the westerly property line of land
owned by Weiler A. Been; thence southeast along the westerly property
line of land owned by Weiler A. Bean about 17 feet; thence south-
westerly on a line parallel to and 161 feet distant from the south-
erly sideline of Griffin Road about 602 feet to the easterly property
line of land owned by Bosomy Mobil Oil Oo. Ino; thence north-
westerly along said property line about 16e feet to the point of
beginning. The above-described area contains approximately 9,900
square feet, or .23 acres.
Recommended damages:
Land Area $460.00
Property owned by Weiler A. Bean, designated as Parcel 3-2,
more fully described as follows:
Beginning at a point formed by the intersection of the easterly
property line of land owned by Philip Shapiro and the southerly line
of Griffin Read as now laid out; thence northeast along the southerly
line of Griffin Road a distance of 1517 feet to on angle point; thence
east a distance of 30 feet to a point; thence southwest along a line
parallel to and 10 feet distant from the southerly line of Griffin
Road a distance of 1537 feet to the easterly property line of land
owned by Philip Shapiro; thence west

about 161 feet to the point of beginning. The above-described
area contains approximately 25.195 square feet, or .58 snree.
Recommended damages:
Land Area $1,160.00
The recommended land damages are based on a rate of two
thousand dollars per acre for undeveloped land and fifty-five
hundred dollars for improved land. Damages for paved areas are
based on a rate of thirty cents per square foot.
Land Taken for Slope Basements and Temporary Grading
The description of areae on the following properties which
were taken for the purposes of slope easements and temporary grading
by Council Order 198.1-P, passed August 6, 1962, are hereby d1s-
continued, and the following descriptions are substituted, as shown
on Maine State Highway Commission Plan SHO File #10-147 Federal
Project R -AD -12(1), Revision 2, dated July, 1962 Right of Way Map
for the construction of Griffin Road, Ohio Street and Davis Road
(Capehart Housing).
Property Owned by Socony Standard 011 Company
Temporary Grading (Revised)
Property owned by Socony Standard 011 Company designated
as Parcel 1 on right of way map granting the right unto the City of
Bangor and its agents for Ube duration of the construction period
of Federal Project R -AD -12(1) as determined by the date of comple-
tion of work according to the records of the State Highway Commission
to enter upon the land outsiia of the right of way limits for all
purposes necessary to grade said land (to include any necessary
excavating, ulacing of fill material, leaving, seeding and other
incidental work) to conform to the adjacent construction within
the limits defined by the grading limits line between station
1 + 00 and station 2 + 36 right of the Baes line on Griffin Road
s shown on the above-described right of way map. The area within
the above-described limits contains approximately 1090 square feet.
No damages recommended.
Property Owned by Philip Shapiro
No slope easement will be required, since the side slopes are
within the area of the proposed right-of-way taking described above;
accordingly, no damages are recommended.

Property Owned by Weiler A. Bean
Slope Easement (Revised)_
Property owned by Weiler A. Bean and designated as Parcel
3-2 on the right of way map to enter upon the land outside of the
right -o£ -way limits and construct and maintain elopes of the high-
way as long as they are necessary for highway purposes on land
outside of and adjoining the boundary lines of Griffin Road within
the limits defined by the construction limit lines between station
11 + 50 and station 14 + 00 right of the Base line on Griffin Road
as shown on the above-described right-of-way map and containing
.05 acres.
Also a second area defined by the construction limit lines
between station 21 + 75 and station 23 + 63 right of the Base line
on Griffin Road as shown on the above-descrlbed right-of-way map
and containing .06 acres.
Me total of both areae is .11 acres.
No damages recommended.
There appeared at the time and place set for the meeting, the
following persons:
Mr. R. M. Evans, representing the Socony Mobil 011 Co., Mr.
Weiler A. Bean, Abraham Stem, City Solicitor and John Frawley,
Acting City laglneer.
Those present were in favor of the reconstruction of the
street, but questioned the need for additional right of way taking
on their side of the street, that being the south side. The Acting
City Engineer explained that the existing road would be widened con-
siderably, and that the prepared plans indicated many more existing
utilities along the north side of the existing roadway, the re1C-
cation-of which would substantially increase the cost of the project
if the road were widened in that direction.
Mr. Weiler Bean was informed that the plans provided for the
replacement of his fence now located along the existing south right
of way line, and that the new fence would be moved back to the new
right of way line. The owners were also informed that the grading
and slope easements which had been previously issued were being
revised to exclude the area which is now within the area of proposed
land taking.
A plan prepared by the State Highway Commission showing the
properties in question accompanies this report.
