Cornish of Amherst, Massachusetts for architectural services on the first nice, and WHEREAS, the city wishes to use Mr. Cornish's architectural services on the second nine, NOW, THEREFORE, BE IT ORDERED that the City Manager be and is hereby authorized to enter into another contract with Mr. Cornish for said A copy of the new contract is on file with the City Clerk. Delano absent. ., . _ . .f �Counciluan UCllYL EAN THIS AGREEMENT made and entered Into this day of 19639 by and between the CITY OF BANGOR, a municipal corporation xlthla the Oounty of Penobscot and State of Maine, acting by and through Its City Manager and Blrector of Recreation, (hereinafter called the City) and GEOFFREY S. CORNISH, of the Toxo of Amherat, Massachusetts, (hereinafter called the Architect) WITNESSETH THAT: WHEREAS the City desires to expand the existing nine (9) hole golf course presently under construction to eighteen (18) holes on the premises of Webster Avenue consisting of an additional sixty (60) acres, more or lees, all of which Is owned by the City, and for this purpose requires the services of an expert golf course architect, and WHEREAS the Architect represents to the City that he is skilled and experienced in the profession of golf course erobl. tecture, and is in all ways qualified to design and supervise the construction of the above described golf course and to see to it that It in constructed and completed In mm expert manner and to be of the finest quality and of the highest degree of perfection, (commensurate with the budget), NOW THEREFORE the parties agree, each with the other, as follows: 1. The Oity hereby employs the Architect to plan, design, IV out, prepare specifications and supervise the construction of an additional nine (9) golf holes, said nine (9) holes to be compatible with the existing nine (9) holes now under construction so as to provide a continuous eighteen (18) hole golf course upon said premises on Webster Avenue, and the Architect does hereby accept said employment for said purpose. 2. a. The Architect agrees to study adequately said premises and thereafter within a reasonable time to submit to the City a circuit plan of the 18 holes and detail plans of each of the additional 9 greens to be built, a water system plan and a tree planting schedule for the 9 holes to be built, and all speolflcationa necessary for the letting of a contract or con- tracts for the additional 9 holes or for direction of City em- ployees if the work is done directly by the City. b. The Architect shall render his opinion and assistance in letting of the contract in connection with the construction. c. Luring the physical construction of said golf coarse the Architect shall provide necessary architectural supervision in the form of visits once every two weeks. 3. The City agrees to pay, and the Architect agrees to accept, for the services to be rendered under terms of this agree- ment the total sum of twenty-five hundred dollars (&2,500) payable as follows: a. $1,000.00 payable on January1, 1964. b. 81,000.00 payable on September 1, 1964. a. #500.00 payable on January 1, 1965. 4. GENERALLY, the Architect shall provide those services not hereinabove enumerated which are customarily and usually per- formed by a golf course architect, Including direction of con- struction and consultation with all other persons designated by the City concerning items pertaining to golf in any phase of the general construction upon said premises. 5. The Architect agrees to devote his best efforts and attention to the prompt and successful conclusion of the con- struction of said golf course. _2_ IM WITNBBS WRRRBOP the City of Bangor has caused its corporate seal to be hereto affixed and these presents to be signed in its name and behalf by its City Manager and by its Director of Recreations and the said Geoffrey S. Garnish has hereunto set his hand and seal the day and year first above written.
