Councilor Barry voting no. Agreement made this 30th. day of September, 1961, by and between EdULd R. Dysart, of Brewer, county of Penobscot, and State of Maim, hereinafter called "Seller", and City of saner, a municipal corporation, within the County of Penobscot, State of Maine, hereinafter called 'Purchaser". MMEBEAS the Seller is the owner of certain property located in the Sown of Minterport, County of Maids, State of Maine, said property being more particularly described in "Schedule A" annexed hereto, and MI@RF.AS the Purchaser wishes to purchase said property as described In "Schedule A" armexed hereto{ NC1t TB WOM, in consideration of these presents, and in consideration of $1.00 and other valuable considerations paid to the Seller by the purchaser, the receipt of Mich is hereby acknowledged, it is agreed by and between the parties hereto, as follows, 1. The Seller hereby agrees to sell, and she purchaser hereby agrees to purchase, the premises described in "Schedule A" annexed hereto. 2. The Purchaser agrees to pay the price of $20, Co0.00 for said property, and upon receipt thereof the Seller agrees to give a good and sufficient warranty deed conveying said property to the PurChaser. It is agreed that the deed will contain a description of the property Mich is owned by the Seller and is subject to this agreamenttwhich Is satisfactory to the City engineer of Bagor, it being further understood that said description may differ from that in "Schedule A" annexed hereto. It is further agreed that taxes assessed in contemplation of law shall be pro rated as of the date of the closing. 3. The closing shall take place on April 6, 19629 at the office of the city Manager of Bngory Maine. 0. This sale 3s conditioned upon the Seller being able to convey a good and merchantable title as of April 6, 1962. 5. The seller agrees to furnish to the purchaser an abstract or abstract$ of title covering the subject promises. 6. This agreement is binding on the Seller, his heirs and assigns, and the Purchaser its successors and assigns. Daisy o. Dysart joins herein and consents hereto for the purpose of agreeing to release all has right, title and interest which she has in and to the above described premises. THIRDS Several lots or parcels of land, situate in said wintexport, being the same premises described in the deed of Joseph E. Cloutier to E. R. Dysart, Inc., &too May 239 1957, and recorded in Voluw 5493 Page 514 of the Waldo County Registry of Deeds, the Provisions of said deed being hereby incorporated by reference.
