Perkin Project. / Parking .m AjeOi ���`�� Co®cllmev WHEREAS the City Of Bangor by its Council Order No. 239-N dated October 9, 1961, and entitled "Accepting Report of city Engineer on Layout of Kenduskeag Strewn Parking Lot", exercised its power of Eminent Demain in connection with the so-called Kenduskeag Stream Improvement Parking Area Project, and acquired title to that portion of the property owned by The Merrill Trust Company on the Kenduskeag Stream in the City of Bangor, which is located east of a line that "follows the existing timber crib work, granite wall, or the vertical projection downward of the outermost projection of any structure which is an integral part of a building adjacent to the existing waterway of Kenduskeag Stream", and WHEREAS it has been determined by the City of Bangor that that portion of the land, which was so acquired by the City fwem The Merrill Trust Company, and which is described in Schedule "A" attached hereto, is not necessary to the City in the operation of its stream and parking facilities, and MEREAS it has further been determined that in order for The Merrill Trust Company to make effective use of the property described in said Schedule "A", it is necessary for The Merrill Trust Company to have an easement in the property described in Schedule "B" Aached hereto for the purpose of laying and maintaining a foundation, below the ground level, for the support of such building as it may constWct in the remodeling of its existing Wilding; which remodeling is of benefit to the City of Bangor. THEREFOR IT IS ORDERED that to clarify the status of the title to the land described in said Schedule "A" and to grant an easeaent in the property described in said Schedule "B", for the purpose set forth above, the Treasurer of the City of Bangor be and he is hereby authorized, upon such towns and conditions as the City Solicitor and the City Engineer may approve, to execute a deed running frm the City of Bangor to The Merrill Trust Company3 conveying to said The Merrill Trust Company the property described in said Schedule "A" and the precedent in the property described in said Schedule "B". SCHEDULE A Beginning at a point on the easterly wall of The Merrill Trust Company Main Building, said point being 19.0 feet southerly from the intersection of the easterly and northerly building lines of The Merrill Trust Company Wild- ing; thence at right angles to said easterly wall of The Merrill Trust Company building in an easterly direction 12.07 feet to a point (which said point is also located 17.44 feet from the southerly line of the west abutment of the Hammond Street Bridge and on a line drawn perpendicular to said southerly line of said abutment); thence deflecting to the right by an angle of 73 degrees 30 minutes and running generally southerly in a continuation of said line drawn perpendicular to said southerly line of said abutment, 1.56 feet to a point; thence deflecting to the right and running parallel with the easterly line of the Main Wilding of the Merrill Trust Company 50.25 feet to a point; thence in a westerly direction at right angles to the last described line 12.50 feet to the easterly wall of The Merrill Trust Company building; thence in a northerly direction by and along said easterly wall of The Merrill Trust Company building 1.5 feet to the southerly line of the ex- isting bay, so-called; thence in an easterly, northerly and westerly direction around the perimiter of the existing bay for a distance of approximately 69 feet, to the intersection of the northerly wall of the existing bay of Lhe easterly wall of the Main Building of The Merrill Trust Company; thence northerly along said easterly wall of the Main Building of The Merrill Trust Company, a distance of 1.50 feet to the point of beginning. The above described area contains approximately 135 square feet. SCHEIgULE B Land for footing Easement Beginning at a point which is located by commencing at the inter- section of the easterly and northerly building lines of The Merrill Trust Company main Wilding and running southerly along the said easterly line of The Merrill Trust Company main Wilding 19.0 feet to a point and thence running easterly at right angles to the last des- cribed line 12.07 feet to the point of beginning (which point of be- ginning is also located 17.43 feat from the southerly line of the west abutment of the Hammond Street Bridge on a line. brawn perpendicular to said southerly line of the west abutment); thence in a generally xbxb southerly directionnthe extention of said line drawn perpendicular to the southerly line of the west abutment of the Hammond Street Bridge 1.56 feet to a point' thence deflecting to the right and running southerly on a line parallel with the easterly line of The Merrill Trust Company main building 50.25 feet to a point; thence in an easterly direction at right angles to the last described line 2.5 feet to a point; thence in a northerly direction and at right angles to the last described line 51.75 feet to a point; thence running westerly and at right angles to the last described line 2.93 feet to the point of beginning. The above described area contains approximately 129.7 square feet.
