As amended, PASSED - • �.' 202-Q - 2 KNEN ALL MEN By THESE PRESENTS, that the City of Bangor, a Municipal Corporation located in Penobscot County, State of Wine, in consideration of one dollar and other valuable considerations, (the total consideration being less than $100.00) paid by Harold A. Byther of Waterville, County of Kennebec, Maine; Dorothy I. Baseman, Goldie I. Pressey of Old Torn and Cora B. Libbey, of Bangor. Penobscot County, Wine, the receipt whereof is hereby acknowledged, do hereby bargain, sell, convey, transfer and deliver unto the said grantees, their heirs and assigns, a permanent easement to enter on to a portion of Smith Street, located in said Bangor, and more particul- arly described as a strip of land 3 feet wide, being that Part of the northerly side of said Smith Street, lying southerly of a certain lot or parcel of land more particularly described in a certain deed dated February 21, 1905 and recorded in the Penobscot Registry of Deeds, Vol. 746, page 241, and now owned by the above named grantees, for the Purpose of making all necessary repairs to the buildings located an said lot or Fiscal of land. no said Harold A. Byther, Dorothy I. Scammon, Goldie I. Pressey and Cora B. Libhey, their heirs and assigns hereby covenant that they will indemnify and save harmless the said City of Bangor, its successors and assigns of and from any and all liability that may be occasioned by the use of said strip of land for the afore- said purpose of making repairs. TO HAVE AND TO HOLD the above described promises with all privileges and appurtenances thereof to the said Harold A. Byther, Dorothy I. Scammon, Goldie I. Pressey and Cora B. Libbey, their heirs and assigns forever. IN WITNESS WHEREOF the said City of Bangor has caused in Its name this instru- ment to be signed and its corporate seal to be hereunto affixed by Ralph L. Waymouth, its Treasurer duly authorized by vote of the City Council of the City of Bangor, at its regular meeting duly called and held on August 12, 1963. this day of August, 1963. 202-0 - 3 Signed, sealed and delivered in presence of GUY of BANGOR County of Penobscot as: August 1963.
