File #10-147 sheets 1 to 7 inclusive, dated July, 1962 of the Maine State Highway Commission for Federal Project R -11-12(D) Bangor (Capehart), and be it further ORDERED, that the City Engineer, acting for and on behalf of said munlcipal officers, proceed to give written notice of each intention of said municipal officers by posting notices for seven days in two public places in the City of Bangor and in the vicinity of the proposed construction more fully described as follows: Beginning on Union Street at the intersection of Griffin Road; thence proceeding easterly along the Griffin Road for a distance of about 29400 feet to Ohio Street; thence northerly on Ohio Street for a distance of 7,664 feet to the Davis Road; thence easterly on the Davie Road to the Finson Road a distance of about 3,975 feet and southerly along the Finson Road for a distance of about 800 feet, and the OSty Engineer is further ORDERED, to make a written return of said proceedings containing bounds and ad -measurements of all land taken for widening, elope easements, clearing easements, drainage and temporary grading, together with a list of damages allowed to each person for all land so taken or for any benefits resulting to the property owners as a result of new construction, all in accordance with the laws of the State of Maine. Coungilmn $TY 0.FRN I CITY OF BANGOR, To the City Council: Pursuant to an order of the City Council, passed July 23,1962 directing the City Engineer to lay out land for the reconstruction of Griffin Road, Ohio Street and Davis Road and land for slope, temporary grading clearing and drainage easements, the City Engineer begs leave to report That of his intention to lay out land for above purposes, the City Engineer gave written notice by notices attached to copies of said order pasted for seven days prior to the 2nd day Of August, 1962 in two public places in the City of Bangor and in the vicinity of said street, to wit: One on Bulletin Board - City all One on Griffin Road at Union Street One on Ohio Street at Davis Road and also gave notice by causing the same to be published in the BANGOR DAILY NEWS, newspaper printed in said city, for one week prior to the 2nd day of August, copy of said order and notices, Sc posted and published, is hereto annexed and made part of this report. No damages recommended. - 20- There appeared at the time and place set for the meeting, the following persons: Mrs. Natalie Johnson, Mrs. Maurice Eastman, Mrs. Muriel Smith, Mr. Stanley A. Young, Mr. A. H. Gran, Mrs. Axel Gran, Mr. Bert Shepherd, Mr. George Smith, Rev. Harry Bubbling, representing the East Coast Conference of the Evangelical Covenant Church, Abraham Stern, City Solicitor and J. L. MacLeod, City Engineer. Those present were all in favor of the reconstruction of the streets but questions were raised as to damages which would be recommended. The City Engineer pointed out that where slope case- ments, asements, temporary easements, clearing easements and drainage ease- ments were involved that no damages would be recommended since it appears that the benefits which will be derived by the abutting property owners would far exceed any damages which may result to the property as a result of the new construction. Some property owners raised the question as to whether or not assessments would be levied to help defray the coat of this new construction and assurances were given that assessments would not be levied for this purpose. The City Solicitor advised the persons present as to their rights under the law to appeal in case they were not satisfied with the damages allowed. A large number of trees will be removed during the process of this new construction but the greater majority of these trees are within the right of way limits of the streets on which they are located and, therefore, no damages have been recommended. Where trees are on private property beyond the limits of the right of way and have to be removed due to the new construction, damages have been recommended and are included in the report.
