That Chapter VD, Article I of the Laws and Ordinances of the City of Bangor
ba and hereby is repealed and replaced with the following:
CHAPTER VII
ARTICLE 1 - EXPLOSIVES
Sec. l Definitions. When used in these regulations, the following terms and
definitions shell prevail.
1.1 Fire lospector. The term "Fire Inspector" Shan mean the Fire
Chief of the City of Bangor.
1.2 Manufacturer. The term "Manufacturer" shall mean any manufacturer
Of explosives who ships explosives into this State.
L3 Distributor. The to no "Distributor" shall mean any pe tech acting
as a manufacturer'a agent or jobber who deals in
explosives and sells to retail dealers or to large conemners.
1.4 Retail Dealer. The term 'Retail Dealer" shall mean any person who
has a magazine Sud Sells exiiosives to users of same.
1.5 Explosives. The term 'Explosives" shall mean and include any chemical
compound or mechanical mixture that is commonly used or
intendedfor the purpose of producing an explosion, that remains any
xidizing and combustible units or other ingredients to such proportions,
quantities or packing that m ignition by fire, by friction, by concussion,
by percussion or by detonator of any part of the compound or mixture may
cause such a sudden generation of highly heated gases that the resultant

gaseous pressures are capable of producing destructive effects
oontiguous objects or of destroying life or limb. The term
ezplosives rv"explos ' shall not include cartridges for
mall arms or shotguns,components thereof, or such
fireworks or signalling devices as are designated by the
Insurance Commissioner of Maine, nor shall such terms
include Ship's signal or emergency equipment.
1.6 Magazine. The term "Magazine" shall mean a building or box
specially designed, constructed and used only for the
storage of explosives.
1.7 Barricade. The term "Barricade" shall meanuatmal features of
the ground each as hills or timber of sufficient density
that the eurrcunding exposures cannot be seen when the trees are
bare of leaves of an "efficient artificial barricade" consisting of an
artificial mound or properly reverted wall of earth or a minimum
thickness of three (3) feet at tap.
1.8 Person. The term "Person" whenever used in these regulations
shall be held to mean and include firms and corporations
as well as natural persons.
1.9 Owner. The term "Owner" shall mean and include the person or
persona having a motor truck or vehicle in his or their
possession or as a lessor under alease or contract of conditional
sale or other like agreement.
1.10 Permit. The term "Permit" whenever used in these regulations
shall mean a written authority of the Insurance Commissioner
or Fire Inspector to have, keep, stare, or sell.

Sec. 1Sec. 3
1.31 Motor Truck. The term "Motor Truck" shall mean and include all vehicles
operated or propelled by any form of engine motor or mechanical
poster and designed or used fee carrying freight or merchandise,

dise.

1.11 Chassis. The term "Chassis" shall mean and include the entireeehicle
exclusive of the body or any load thereon.
1.15 Driver. The term "Driver" shall mean

a motor truck or drives avehicle.

2.1 Issuance of Permit. The Fire Inspector shall not issue a permit to
transport or use explosives or gunpowder until he
is satisfied as to the ideutiky of the applicant and as to Mat use the

years of age and a citizen of the United States. No permit shell be given
to any transient or person of poor repute who night make illegal use of
explosives or gunpmrder. The Fire Inspector shall keep a record of all
permits issued by him.
2.2 Refusal to Issue Permit. Whenever the Fire Inspector shall refuse to
issue a permit to any person or persons far the
transportation ore o£ explosives or gunpowder, he shall forthwith
notify the Insurance Commissioner.
2.3 Violation of Law. 'Awn the Fire Inspector finds evidence of violation
of the ]err relative W the storage or transportation
of explosives or gunpowder, he shall immediately bring the matter to the
attention of the Insurance commissioner.

3.l Written Permit. No person shall keep, store or deal in any explosives
unless he shall first obtain from the commissioner a
vxitten permit therefor. the permit so granted shall be valid for one
year and shall definitely state the location of the Wilding where sudr

3.2 Storage in Magazines. Magazines in which a plesivee may lawfully be
kept or stored shall be a Wo (2) classes, ac
follows known as Class A and Class B.
(a) Class A magazines stall consist of those containing explosives
exceeding fifty ($0) pounds, and shall be constructed of woods
brick, concrete, iron, or wood covered with iron and shall have
no openings except for ventilation and entrance.
(b) If oe frame constav coon, they shall be so built as to provide for
not less than a six (6) incd all a coarse dry sand between the
outside and inside sheathing and shall be covered an the outside
by galvanized from not less than 26 gongs in thickness. In lieu
of such send filling a mixture of one part taunt and tar parts
of sand may be need.
(c) If built of brick the walls shell be eight (8) inches in thlclmess
Wilt of a medium soft brick laid in a mild mortar.
(d) If Wilt of concrete blacks, the walls shall be at least eight (6)
inches in thickness and the sir spaces in the blocks shall be filled
with coarse dry sand. Cement blocks need for this purpose shall be
mads of a composition not stronger than one part of cement to seven
parts of sand.
(e) If built of from, the walls shall be lined with four inches of medium
soft brick laid in a weak mortar of four inches (411) a wood.
(f) All magazines shall be built on firm foundeticnss either of concrete,
brick, cement block or stone wall and shall be sufficiently high to
insure proper ventilation.
(g) All magazines unless specially exempted on account of location shell
have a 4 inch (4") sand filled bullet proof ceiling.
(h) The roof shall be covered with sheathing vhich in turn shall be
covered with not leas then 26 gunge corrugated iron lapped tan
corrugations unless covered with net metal with standing seam.
(i) For the purpose of providing ventilation below the floor level
there shall be openings six inches (6") in width by four inches (4")
in height spaced not more than five feet ($m) apart on all sides
of the mmgazines these openings to be screened with strong }" wire
mesh. Ventilating openings above tie sand filled ceiling shall be
of the same size ami space screened In a like manner or the space
above the ceiling W be ventilated by suitable weatherproof sheet
metal ventilators located on the roof.

(j) The interior ventilation shall be provided by leaving a space
two inches (20) in width between the edge of the floor and the
wall about the entire perimeter (face) of the floor except at
the door opening and providing a sizilar apace 2 inches l2") in

3.4 Temporary Magazine. Tempor Magazine - such az wed on construction
projects, shall be restricted to a maximum of ten
thousand (10,000) pounds of storage of explosives and shall meet the
requirements specified for a permanent magazine, excepting that the
foundation may be of other than concrete or scenery provided the magazine
is securely fastened to the ground. Not more than three such magazdnes
shall be used at any one tine on ary construction project.

3.5 Co®artnent for Explosives. All explosives transported by vehicle with

3.6 Portable Mwwdne. Portable magazine, such as used on construction jobs,
shall meet the same construction requirements set
Porth for vehicular magazines but are restricted to a variance storage of
one hundred (100) pounds and shall be securely locked to prevent an -
authorized awittance. All explosives stared in portable magazines east
be returned to a permanent or teeporary magazine before sunset on each
day of usage.
3.7 Blacking: Cars. Blasting caps or electric blasting caps, net exceeding

manner but in separate magazines of the same construction as outlined

event shall there be any storage of such Meeting caps or electric

3.8 Storing Ceps With Other Explosives. Sleeting caps or electric blushing

explosives regardless of quantity.
3.9 Looking of Magazines. Each explosive magazine shell be securely lacked

placed therein or being removed therefrom.
3.10 Access to Magazines. Only the owner, or persea authorized by the
owner, shall have access to nagazin s.
3.11 Suitable Locks. Each permanent storage magazine shall be equipped with
a suitable lock.
3.12 Posting of Permits. Perrier for the storage of explosives shall be
posted on the inside of the magazine door and a
copy of same kept in the office of the magasine keeper.
3.14 Opening Explosives. No package of explosives shall at any time be
opened within fifty feet of any magazine. A
wooden wedge and a wooden mallet well be used for opening explosive

3.18 Artificial Light and Neat. No artificial light other than portable

3.19 Interim of Fknloeive Magazine. Before any repairs or alterations
are made to the interior of an
explosive magazine, the explosives must be removed therefrom and
the magazine shall be thoroughly cleaned and the Conmiasimer and
the Fire Inspector notified.

Sec. 4 Storage of Gunpowder. All the provisions of Section 3 relative to We storage

Sec. 5 Standard Table of Distances. Whenever new baildings are erected or new

sec. 6 -
Sec. 6 Trans tine Erolosives No person shall transport in the City of Bangor
explosives isquantities of more than $0 pounds
or gunpowder in quantities of more then 500 pounds or more than IAO blasting
or electric bloating caps until he wall first obtain from the Commissioner
and from the Fire Inspector a xritten permit therefor. Transportation
permits so granted well be good for one year. Neter trucks or vehicles
used by permittees for such trawportation must comply with the following:
6,1 Notor Trucks. Eae manufacturer or dealer in explosives who nekes
deliveries of explosives in the City of Bangor shall
have one or more suitable motor trw1hs for such purpose.
6.2 Condition of Trucks or vehicles. Motor trucks or vehicles when used
for transporting plosives over the
streets of this city must be strong enough to carry the load and in
ffrat-class condition. The battery and wiring of motor truck meat be
located so teat neither x111 conn in contact with packages of plosives.
All electric wiring must be completely protected and securely fastened
to prevent shorteircuiting. Worn insulation host be repaired before
acv explosives are loaded on the enter truck. The aides and ands a an
open -bodied motor truck, or vehicle, must be high anough to prevent
packages of plosives from falling off. The floor oP each motor
truck or vehicle must be tight so that nothing can pass through it.
Any exposed sparking metal on the imide aY the body liable to home

or other nw�etallic material.
6.3 Signs an Motor Trucks. Each such motor truck shell bear signs on the
fronts rear eM each side bearing the words
eEMCSIVESm in letters not less than four inches (4') in height. The
lettering scall be WEITE. When plosives are being carried alexin
a red flag net less then teenty-Sour (2421) inches square shall be
conspicuously displayed on the left front and rear of said motor track.
6.4 Special Peraft Required. Not more thaw two (2) tons oP dynamite as
similar plosives shall be transported on a
motor truck or vehicle at acv one time through any public street or
higbv unless a special penmit is secured Prom the Commissioner and
from the Fire Inspector.
6.5 Fire Extinguishers. Each such enter truck or vehicle so used shall be
equipped vlth two (2) fire extinguishers of a type
to be approved by the Commissioner wMch shall be properly charged and
in good working order at all tinea.
6.6 Mechanical Condition a Truck. Each actor track wed in the transportation
of explosives shall be in good mechanical
condition and at he time shall It be loaded beyond its capacity.
6.7 Daily Inspections. Each usher or operator of such vehicle, if it be
a inter truck shall make daily inspections of his
vehicle and see that the fire extinguiehers are In good condition, that
Ube chassis, motor and pan are free from grease and oil and test all of
the mechanical parts are in good sorting order and Chat tracts, tractors,
and trailers we equipped with spare tires.

6.8 Explosives on Trucks or semitratlexs. Any explosive other than liquid
nitroglycerina desensitized liquid
nitroglycerin or diethylene glycol dinitrate and forbidden explosives
may be loaded into and transported on any true* or say semitrailer
attached to a tractor, to which no form of trailer nay be attached
when so loaded.
6.9 Requirements. Not more then $0 pounds of explosives or 500 pounds of
gapowder nor more than 100 bloating cape or electric
blasting cops shall be transported In any motor truck in the City of
Bangor which does not comply with the above requirements,

6.12 Loading and Unloading Explosives. In loading or unloading explosives
care shall be given to the handling
of same and in loading a motor truck or vehicle the cases shall be

6.2$ Public Conveyance. No person will transport, either on his person or

of the City of Bangor without first securing a permit from the Insurance
