Leve and Ordinances of the City of Bangor, Maine be and is hereby
amended by adding thereto a new article, as follows:
CHAPTER VII
ARTICLE 10 - BOILOING EXITS CODE
See. I Adopting Building Exits Code. That the code for public
safety from fire, namely,
the "Building Exits Code", Seventeenth Edition, 1960,
published by the National Fire Protection Association,
be and is hereby adapted for the City of Bangor, and
that the enforcing authority shall be the Fire Chief
of the City of Bangor or the City Building Inspector.
Sec. 2 Violations. The Building Inspector or the Fire Chief
of the City of Bangor shall send a Witten
order to The owner, his agent, lessee or occupant of a
building or structure used for public aaaembly an defined
by the Building Exits Code requiring any conditions which
exist in violation of said Building Exits Code to be
corrected.
Sec. 3 Time Limits. Such written order when relating to a
building or structure used for public
assembly, as aforesaid, shall require any conditions
which exist in violation of said code to be Corrected
within thirty (30) days after the order is sent. Said
Witten order, when relating to any other building or
structure, shall require any conditions which exist In
violation of said code to be corrected within sixty (60)
days after the order 1e sent.

Sec. 4 Appeals. An appeal may be taken from any order issued
by the Building Inspector or Fire Chief, or
from their refusal to grant a permit, to the municipal
officers and from the municipal officers to the Superior
Court.
4.1 Municipal Officers. on an appeal In writing to the
municipal officers, they shall
at their neat meeting affirm, modify or set aside
the decision of the Building Inspector or Fire Chief
according to the terms of the pertinent ordinance.
They may permit a variation from the terms of an
ordinance w1cere necessary to avoid undue harshlp,
provided there is no substantial departure from the
Intent of the ordinance. They may permit an exception
to an ordinance only when the terms of the exception
have been specifically set forth by the municipality.
The failure of the municipal officers to issue a
written notice of their decision, directed to the
appellant, within thirty (30) days from the date
of filing of the appeal, constitutes a denial of
tha appeal.
4.2 Superior Court. The appeal to the Superior Court
shall be entered at the term first
occurring 1n the county not leas than thirty (30)
days after the order or decision from which the
appeal is taken. Notice of the appeal shall be
ordered by the Court in term time or by a Justice
in vacation, and the appeal shall be tried and
determined by the Cort without a jury in the manner
and with the rights provided by law in other civil
cases so heard. Coats may be awarded to the pre-
vailing party by the Court as justice requires.

Sac. $ Penalty. Any person who violates my order made under
the provisions of this ordinance shall be
punished by a fine not to exceed One Hundred Dollars
(1100.00) plus costs and all Pines shall be recovered
under complaint to the use of the City of Bangor.
