ARTICLE 8 - STREET OPENINGS Sac. I - Sec. 4
Sec. I Permits
I.I Permit Required -No opening in any street or side-
walk shall be made before first
obtaining a street opening permit from the City
Engineer. All permits will be issued In accordance
with the provisions of Chapter 96, 1954 Revised
Statutes of Maine.
1.2 Winter Permits 'No street opening permit will be
Issued between December Isf In any
e year and March 15th In the following year
except for an extreme emergency.
Sec. 2 Work to be Guaranteed If the work of replacing any of the
backfill and/or the surface proves
to be unsatisfactory within a two year period after the
french has been complefeds the area Involved shall be
completely re-excavafed and the patch replaced at the
appllcanfss expense by the Public Works Department crews.
Sec. 3 Street Openings by Utilities All work In connection with
street openings required by
the various utllifies, including Bangor Water Districts
Citizen's Uflllfles Company, Bangor Hydro-Electrlc Company
and New England Telephone d Telegraph Company, shall be
performed by forces of the particular utility concerned
or by an approved contractor working for them.
Sec. 4 Fees for Street Cgenings
4.1 Public Utilities Each year all public uilllfles
shall deliver to the City
Engineer for deposit with the City Treasurers a
performance bond In the amount of five thousand
dollars 1$5,0001 which shall be In full force and
effect for a period of two years from the date of
issue to guarantee the falfhfu1 performance and
replacement of all street openings made for all
service entrances and service renewals. A separate
bond shall be furnished by all Public UtIllfles for
all new
wafer main extensions where a trench In
excess of two hundred feet In length will be
required. The amount of this bond shall be at the
rate of four dollars ($4.001 per square yard for
the number of square yards Involved In the new
extension, but in no case shall this bond be for
less than five hundred dollars 1$500). This
separate bond shall be furnished and delivered to
the City Engineer prior to the start of any
excavation of the main installation.

Sec. 4 — Sec. 5
4.2 Private Utilities A performance bond shall be
furnished in the amount of two
thousand dollars 1$2,0001 each year and this bond
shell be in full force and effect for a per led of
two years and shall guarantee the faithful
performance of the work required In connect Ion
with the installat Ton of any services, rep lacing
existing services and required exploratory work
for and repair of leaks in underground Installs—
flons which are a part of distribution systems.
4.3 Contractor A performance bond may be furnished
for each permit granted for n
underground Installations or for the repair of
existing Installations. This performance bond
shall be In the mount based on the rate of fen
dollars 1$101 per square yard for the number of
square yards disturbed but in no case shall If
be less than one hundred dollars 1$1001. A
performance bond furnished by an approved con—
tractor doing the work will be acceptable if so
desired by the utility.
4.4. New Construction The contractor making the
excavation for an Installation
In connection withany new construction shall
provide a performance bond of not less than one
hundred dollars 1$1001 and deliver it to the
City Engineer prior to the Issuance of the permit
for the street opening. This bond shall be In full
force and effect for a period of not less than two
years from the date of Issue.
4.5 Repair and Renewal Work When permits are
issued
for repairs orrenewals
where the Public Works Department is to do the
work of backfilling and replacing the surface,
the applicant shall deposit with the City Treasurer
the sum of one hundred dollars ($100) to pay for
the work to be performed by the Public Works
Department. After the job has been completed, any
expended funds remaining from the one hundred
dollars ($100) will be returned to the applicant.
Sec. 5 Trenching and Backfilling
5.1 Backfilling Whenever a permit has been Issued for
a street opening and The excavation
has been made, the french or opening shall be
backfilled with the same material That was removed
from the french to wl thin one foot of the as lit Ing
pavement except as may be hereinafter provided.

Sec. 5 — Sec. 6
The top 12 Inches of the trench shall be filled
with approved bank run gravel. If a permit is
Issued during the winter time and the excavated
material freezes, this frozen material shall not be
replaced in the french but shall be removed from
the area and disposed of and the excavated area
backfilled with an unfrozen material similar to that
removed to within 12 Inches of the surface. If the
maferial excavated contains too much moisture for
proper compaction, It shall be removed and replaced
with suitable backfill material.
5.2 Tamping Backfill All backfilling shall be
thoroughly tamped or compacted
either by hand tamping or power tampers. The
first 6 inches of fill over the structure or pipe
In the trench shall be hand tamped. The balance
of the filling shall be thoroughly tamped and, If
hand tampers are used, It shall be placed In
layers not over 6 Inches fh ick. If power tampers
e used, backfilling material may be placed in
12inch layers and thoroughly compacted. Puddling
of the backfill will not be permitted except by
special permission from the City Engineer. All
material excavated for the trench shall be
replaced in the trench except for the amount wh lch
may be di ad l aced by fhe use of gravel for the top
12 Inches. All backfill shall be compacted to
meet at least 90% of total compaction as measured
by the Proctor fest.
Sec. 6 Surfacing
6.1 Hof Asphalt Paving on Rigid Base When an opening
is made on a
a
street where the surface i entconcrete,
premixed surface of far orasphalt or granite
block on a concrete base, the concrete shall be
cut back at least B Inches beyond the edges of
the trench after the backfilling has been completed
and before the new concrete patch is replaced. All
re l nforcing steel encountered when removing the
concrete shall not be cut off but shall be retained
and used for re lnforc Ing In the new concrete when
placed. In addlf ion to the retained re enforcing,
addif Tonal re lnforc Ing sfee I shall be furnished to
provide the equivalent of 1/2 Inch steel rods o
12 Inch centers both ways In the new concrete patch.
The thickness of the concrete in the new patch
shall be at least 4 Inches thicker than the existing
concrete and the fop surface of the concrete
rete In the
patch shall be finished to conform with the surface

Sec. 6 — Sec.
of the old concrete. This new concrete shall be
protected from all traffic for not less than seven
days after being placed. Where granite block is
encountered under the paving, these blocks shall
be removed and the area replaced w th concrete in
accordance w in the requ l rementa above de scr l bed.
After the concrete has been placed and before the
permanent paved surface Is put back, the existing
paving shall be enlarged at least 4 Inches on all
sides, and the edges of the old paving painted with
an asphaltic liquid before the new paving is put
in place.
r 6.2 Bituminous Pawing on Flexible Base When a street
opening permit
Is Issued on a street which has been co nstructed
for heavy traffic and has a bituminoussurface
without a cement concrete base, the same amount of
gravel and/or crushed rock shall be replaced in
the french as is removed when the excavation Is
made where this material exceeds the 12 Inch depth
as specified in item 4. When crushed rock Is
encountered directly below the bituminous pavement,
alike amount of crushed rock shall be replaced
and this crushed rock shall be penetrated with an
approved liquid asphalt at the rate of at least
e gallon per square yard before the permanent
surface is replaced, and the existing paving shall
be enlarged at least 8 Inches on all sides and the
edges painted with an asphaltic liquid before the
new paving is placed.
6.3 Temporary Surfacing On all streets where a
permanent pavement has been
built, the permanent surface shall be replaced
after the french has been properly backfilled
except that when openings are authorized after
November I, In any one year, a temporary surface
of premixed bituminous material shall be used and
this temporary patch shall remain until the fol—
lowing year when the permanent surface shall be
replaced. On all other streets, the trench shall
be patched with premixed bituminous material as
soon as the backfilling has been completed and
the joints between the old and the new material
shall be sealed to prevent surface water from
penetrating through the joint. In all cases
whenever or wherever a street opening has been
made in any road, street or sidewalk having a
permanent or semi—permanent surface, the edges
of the pavement shall be squared up before the
permanent patch Is replaced.

Sec. 6 - Sec. T
6.4 New Construction Where new private construct Ion
Is In progress and excavation
In the street is required for sewer co nnections,
underground electric and/or telephone service
lines, the work shall be performed by an approved
contractor, Including the excavation and backfilling
and the contractor shall place a temporary patch
over the excavated area Immediately upon completion
of the backfilling. Within thirty days after com-
pieflon of this excavation and backfilling, a per-
manent surface shall be put in place and this per-
manent work shell be performed by an approved
contractor.
6.5 Repair and Renewal Work For all excavations within
the street or right-of-way
limits required to repair or replace existing
Installations by Individuals other than the utili-
ties companies, the excavation and repair work
shall be accomplished by a private contractor.
The backfllling and surface replacement shall be
completed by the Public Works Department employees
and this work shall be at the expense of the owner
or applicant.
Sec. ] Penalties

violating the provisions of this
regulation may, upon conviction thereof, be
punished by a fine of not more than twenty-five
dollars t§25.001 for each offense. Any person,
firm or corporation who shall fall to comply
with the terms and condlflons of these regulations
r any amendments thereto shall not hereafter be
granted another permit to excavate In any city
street or road without the prior approval of the
City Council.

Be it ordained by the City Council of the City of Bangor, as fellows:
THAT Chapter. 6, Article 6 of the Revised Ordinances OftheCity
of Bangor as amended be and are hereby further emended by repealing
Article 8 in its entirety and replacing it with a new Article as
follows:

Sec. 4 Performance Bonds and Fees for Street Openings.
4.1 Bangor Water District. Each year District shall Bangt

City Engineer for deposit with the City Treasurer, a
performance bond in the amount of five thousand dollars
(f$,000) which shall be in full force and effect for a
period of two years from the date of issue to guarantee
the faithful performance and replacement of all street
openings made for all service entrances and service
renewals. A separate bond shall be furnished by the
Bangor Water District where a trench in excess of two
hundred feet in length will be required. The amount
f this bond shall be at the rate of four dollars
($4.00 per square yard for the number of square yards
involved in the new extension, but in no case shall
this bond be for lose than five hundred dollars WOO).
This separate bond shall be furnished and delivered to
the city Engineer prior to the start of My excavation
of the main installation.
4.2 Other Public Utilities. A performance bond shall be
furnished in the amount of
two thousand dollars ($2,000) each year and this bond
shall be in full force and effect for a period of
two years and shall guarantee the faithful performance
of the work required in connection with the installation
of any services, replacing existing services and
required exploratory work for and repair of leeks
in underground installations which are a part of
distribution systems.
4.3 Building Connections. Any person, firm or corporation
making the excavation for an
installation in connection with any new construction
shall provide a performance bond of not lase than ons
hundred dollars (4100) and deliver it to the City
Engineer prior to the issuance of the permit for
the street opening. This bond shall be in full force
and effect for a period of not less than two years
from the date of issue.

4.4 Fee for Reoair and Renewal Work. When permits are
issued for repairs or
renewals where the Public Works Department is to do the
work of backfilling and replacing the surface, the
applicant shall deposit with the City Treasurer a sum
estimated by the City Engineer to be sufficient to
cover the mat of the work to be performed, but in no
case lees than one hundred dollars (1100). After the
Job has been completed, any unexpended funds remaining
will be returned to the applicant.
Sec. 5 Procedures for Trenching and Backfilling.
$.1 Backfilling. Whenever a permit has been issued far a
street opening and the excavation has been
made, the trench or opening shall be backfilled with the
same material that was removed from the trench to within
one foot of the existing pavement except as may be here-
inafter provided. The top 12 inches of the trench shall
be filled with approved beck run gravel. If a permit
1s issued during the winter time and the excavated
material freeees, this frozen material shall net be
replaced in the trench but shall be removed from the
area and disposed of and the excavated area backfilled
with an unfrozen material similar to that removed to
within 12 inches of the surface.

If the material excavated contains too much moisture for
proper compaction, it shall be removed and replaced with
suitable backfill material.
$.2 Tamping Backfill. All backfilling shall be thoroughly
tamped or compacted either by hand
tamping or power tampers. The first 6 inches of fill
over the structure or pipe in the trench shall be hand
tromped. The balance of the filling shall be thoroughly
tamped and, if hand tempera are used, 1t shall be placed
in layers not over 6 inches thick. If power tampers
are used, baokfilling material may be placed in 12 inch
layers and thoroughly compacted. Puddling of the backfill
will not be permitted except by special permission from
the City Engineer. All material excavated for the trench
shell be replaced in the trench except for the amount
which may be displaced by the use of gravel for the top
12 inches. All beoktlll shall be compacted to meet at
least 90% of total compaction as measured by the Proctor
test.
See.6 Replacement of Surface.
6.1 Hot Asphalt Paving on Rigid Hass. When an opening is
made on a street where
the surface is cement concrete, premixed surface of tar
or asphalt or granite block on a concrete base, the con-
crete shall be out back at least 8 inches beyond the edges
of the trench after the backfilling has been completed
and before the new concrete patch is replaced. All re-
inforcing steel encountered when removing the concrete
shall not be out off but shall be retained and used for
reinforcing in the new concrete when placed. In addition
to the retained reinforcing, additional reinforcing steel
shall be furnished to provide the equivalent of 1/2 inch
Steel rods on 12 inch centers both ways in the new con-
crete patch. The thickness of the concrete in the new
patch shall Ta at least 4 inches thicker than the exist -
Ing concrete and the top surface of the concrete in the
P etch Shall be finished to conform with the surface of
the old concrete. This new concrete shall be protected
from all traffic for not less than seven days after be-
ing placed. Where granite block is encountered under the
Paving, these blocks shall be removed and the area re-
placed with concrete in accordance with the requirements
above described. After the concrete has been placed and
before the permanent paved surface is put back, the exist-
ing paving shall be enlarged at least 4 inches on all
sides, and the edges of the old paving painted with an
asphaltic liquid before the new paving is put in place.

6.2 Bituminous Paving, on Flexible Base. When a street open-
ing permit is
Issued on a street which has been constructed for heavy

concrete base, the sane amount of gravel and/or crushed
rook shall be replaced in the trench as is removed when
the excavation is made where this material exceeds the
12 inch depth as specified in item 4. When crushed rock

asphalt at the rate of at least one gallon par square
yard before the permanent surface is replaced, and the

before the new paving is placed.
6.3 Temporary Surfacin ¢. On all streets where a permanent
pavement has been built, the perma-
nent surface shall be replaced after the trench has beer
properly backfilled except that when openings are
authorised after November 1, in any one year, a tempo-
rary aurface of premixed bituminous material shall be
used and this temporary patch shall remain until the
following year when the permanent surface shall be re-
placed. On all other streets, the trench shall be
Patched with premixed bituminous material as soon a
the backfilling has been completed and the joints be-
tween the old and the new material shall be sealed to
prevent surface water from penetrating through the
Joint- In all cases whenever or wherever a street open-
ing has been made in any road, street or sidewalk hav-
ing a permanent or semi-permanent surface, the edges
of the pavement shall be squared up before the permanent
patch is replaced.
6.4 New Construction. Where new private construction s in
progress and excavation in the sheat
is required for sewer connections, underground electric
and/or telephone service linea, the work shall be per-
formed by an approved contractor, including the excava-
tion and backfilling and the contractor shall place a
temporary patch over the excavated area immediately upon
completion a the backfilling. Within thirty days after
completion of this excavation and backfilling, a perms -
Pont surface shall be put In place and this permanent
Work shall be performed by an approved contractor.
6.5 Repair and Renewal Work. For all excavations within the
street or right-of-way limits
required to repair or replace existing installations
by individuals other than the utilities companies, the
excavation and repair work shall be accomplished by a
Private contractor. The backfilling and surface replace-
ment shall be completed by the Public Works Department
smplcyess and this work shall be at the expense of the
owner or applicant.

Seo.7 Penalties-.
7.1 Violations. Any person, firm or corporation violating
the provisions of this regulation may, upon
conviction thereof, be punished by a fine of not more
than twenty-five dollars ($2$.0011 for each offense.
Any person, firs or corporation who shall fail to comply
with the terms and conditions of these regulations or
any amendmenta thereto shall not hereafter be granted
another permit to excavate in any city street or road
without the prior approval a the City Council.
