ExecuTa..Agreement un me_,ean9or water District IN CITY COIMCIL April 23, 1962 Paso AGREEMENT This Agreement made this day of 1962, by and between the City of Bangor, a municipal .corporation located in Penobscot County, State of Maine, and Bangor Water District, e corporation lawfully created and duly existing by virtue of • special Act contained in the Private & Special laws of Maine, 1957, creating the said Bangor Water District, located in said Bangor. WITNESSETH THAT: 1. The Bangor Water District agrees to install water lines and all appurtenances in that area known as the STILLWATER PARK OUR RENEWAL PROTECT approximately as shown on the attached Map #12, which said Map #12 is incorporated herein and made a part of this agreement. 2. In consideration of such expenditures by the Bangor Water District, the City of Bangor agrees to reimburse the Bangor Water District for such capital expenditures as shall exceed ten tinea the estimated net yearly revenue in- crease accruing to the Bangor Water District from the facilities so installed. 3• Said parties hereto agree that the net increase in hydrant rental shall not be less than $700 per year under rates to be filed for approval with the Maine Public Utilities Commission, said amount reflecting a net increase of fourteen hydrants in the renewal project area, and said parties further agree that the average net yearly revenue from all other types of service will be $3,774.36 at existing filed rates, making a total of $4,474.36, justifying a Bangor Water District capital expenditure of $44,743.60. 4. The required capital expenditure estimate is $148,260.00 including engineering and supervision. The City of Bangor and the Bangor Water District are in agreement that ledge excavation, as required, may increase the aforesaid required capital expenditure by a sum up to $309000.00. 5. The City of Bangor agrees to reimburse the Bangor Water District for actual construction cost less the sum of $44,743.60. Such reimbursement shall be made monthly as con- struction progresses. IN WITNESS WHEREOF, the said City of Bangor has caused in its name this instrument to be signed and its corporate seal to be hereunto affixed by Joseph R. Coupal, Jr., its City Maztagei, duly authorized by vote of the City Council of the City of Bangor at its regular meeting duly called and held on April 23, 1962, and the said Bangor Water District has caused in its name this instrument to be signed and its corporate seal to be hereunto affixed by George W. Hawkes, Jr. hereunto duly authorized, on the day and year first above ,written.
