A-venu City Engineer begs leave to report: That of his intention to the City Engineer gave written notice by notices attached to copies of said order pasted for seven days prior to the ..-.-..13th day. of Mar n 1962..,_-.. in two public places in the City of Repair and in the vicinity of said stmt, to wit: One on Stillwater Ave.near Rogan Road One on Rogan Road near Interstate #95 and also gave notice by tensing the same to be published in the Eanaoa D.vLr Naves, ead iodbe movapaperisprinted in said city, for one week prior to the.. -.13th -of Maaeh.1Q62----ropy of said order and notices, so posted and published, is hereto annexed and made part of thin report. And that the said City Engineer and at the time and place of meeting specified in the notices and proceeded to lay oun aald wi den ins as fall ows: Description Beginning at a point formed by the intersection of the southerly side line of Stillwater Avenue And the Westerly side line of Hogan Road as now laid out; thence southeasterly by and along the westerly side line of said Hogan Road for a distance of 477.38 feet to an angle point; thence southerly at a deflection angle to the right of 470-251-00" for a distance of 1,501.17 feet to a point; thence westerly at right angles to the last described line for a distance of 16.5 feet to a point, said point also being 33.75 feet easterly from a granite monument set in the ground in the northerly end of the right-of-way taken for the Interstate Highway #95; thence northerly parallel with and 16.5 feet west- erly from the westerly side line of Hogan Road as now existing for a distance of 1,427.93 feet to a point; thence northwesterly at a deflection angle to the left of 230-421-30" for a distance of 120.83 feet to a point; thence northwesterly at a second de- flection angle to the left of 230-421-30" for a distance of 404.14 feet to the southerly aide line of Stillwater Avenue; thence northeasterly along the southerly side line of Stillwater Avenue a distance of 16.5 feet to the point of beginning. The above described area contains 34,126 square feet of which 330 square feet is owned by John H. Davis and 33,796 square feet is owned by Hugh Davis, Sr. There appeared at the time and place of meeting Mr. Hugh Davis, owner of most of the land area to be taken. The Council action was outlined end he was advised that a value of five hundred dollars ($500) per acre appeared to be a fair price for land at that location. He Was not opposed to the widening but be felt that the land value as recommended was too low. He also stated that some 1,750 feet of pasture fence would have to be relocated and he requested that this work be done by City forces. It was pointed out that the City was not in any position to undertake this type of work and It than was agreed that an additional one hundred ten dollars ($110) would be allowed as damages to reimburse Mr. Davis for the work of resetting the fence which he will do or will have done. No other person or persons appeared to object to or claim damages by reason of the proposed widening. A review of the Assessors' records shows that Hugh Davis, Sr, owns a total of 110 acres of land lying between Stillwater Avenue and the Interstate Highway and bounded on the east by the Hogan Road. The Penjajowac Strom also flows across this lend. The Assessors have divided the property into three categories for "ceasing purpcses. 13 acres Of low land adjoining the stream assessed M $5.00 per acre 90 acres of usable pasture land assessed @ 25.00 per acre 7 acres adjacent to Hogm Road assessed a 500.00 per acre. The land to be taken fort he widening is in the high assess- ment area, and accordingly the City Engineer recommends the following damages: Hugh Davis, Sr. 0.7758 acres ® 8500 per acre $ 390.00 Reset 1,750 St. of pasture fence 110.00 Total damages recommended $ 500.00 John H. Davis owns a lot of land 2001 x 2001 at the corner of Stillwater Avenue and Hogan Road. The assessed value of the land is eight hundred dollars ($800). The land to be taken for the widening is 16.5 feet wide and 200 feet long on the Hogan Road side. On the basis of the assessed value, the land has a value of $0.02 per square foot, and the 330 square feet required would have a value of six dollars and sixty cents ($6.60). This value is obviously too low, and accordingly the City Engineer recommends damages as follows: John H. Davie 330 square footnee $50.00 a.}.d /-So. do It is reccrosanded that the land described in this report be taken and made a part of the public way of Hogan Road to provide a 66 foot right-of-way and that the damages as recommended be approved for payment.
