And that the said City Engineer met at the time and place of meeting specified in the nohese and proceeded to lay out aaid right-of-way as follows: Descr 1plion of layout for Sewer Easements from Odlin Road to Hildreth Street Beginning at a point on the westerly side line of Cdlin Road, said point being about 25.5 feet northerly from the northerly right- of-way line of the Maine Central Ra l l road; thence westerly for a distance of 469.5 feet to a point which is 25 feet northerly from said Railroad right-of-way line and also being station 5+35.5; thence westerly at a deflect Ion angle to the left of 7048' for a distance of 304.5 feet to a point which is 25 feet northerly from the Maine Central Railroad right-of-way and also being station 9+20.0; thence northwesterly at a deflection angle of 430301 to the right for a distance of 65.0 feet to a point at station 9+85.0 and crossing the right-of-way for the railroad spur to Dow Air Force Base; thence westerly at a deflection angle of 500-001 to the left for a distance of 400.0 feet to a point which Is 25 feet northerly from the northerly right-of-way line of the rat lroad and being station 13+85.0; thence westerly at a deflection angle of 60-301 to the right for a distance of 2400.0 feet to a point which is 30 feet northerly from the right-of-way line of the railroad and at station 37+05.0; thence westerly at a deflection angle of 90-301 to the right for a distance of 576.5 feet to a point at station 43+61.5; thence westerly at a deflection angle of 380-12r-30" to the right for a distance of 529.6' to a point at station 48+91.1; thence at a deflection angle of 480-071 to the left for a distance of 96.9 feet to a point at station 49+08, this last described line crossing the right-of-way for the railroad spur to the Bangor Real Estate Development area; thence northwesterly at a deflection angle of 730-141 to the right for a distance of 219.6 feet to a point at a at Ton 52+07.6; thence northwesterly of a deflection angle of 40-421 to the right for a distance of 252.7 feet to a point at station 54+60.3, said point also being on the center line of the easterly end of "D" Street as shown on a plan of streets for the Bangor Real Estate Development Company; thence northwesterly at a deflection angle of 520-34t to the left for a distance of 347.4 feet to a point on the center line of "D" Street of station 58+07.7; thence westerly at deflection angle of 360-301 to the left and along the center line of said "D" Street to the easterly side line of Hildreth Street a distance of 724.3 at station 65+32.0, said point also being 1870 feet southerly from the southerly side line of Hammond Street, measured by and along the easterly side line of said Hildreth Street. The above described line Is the center Il ne for the proposed new sewer and right-of-way extending from Odlin Road to Hildreth Street, said right-of-way being about 50 feet wide measured 25 feet northerly from said center line and southerly to the railroad right- of-way from the Odlin Road to station 37+85, a distance of 3719 feet, and being about 50 feet wide measured 25 feet each way from the described line from 37+85 to sfatlon 52+07.6, a distance of 1422.6 feet, and thence being within the right-of-way limits of "D" Street as proposed to Hildreth Street, a distance of 1324.4 feet. There appeared at the time and place set for the meeting the following: Mrs. Barbara Simpson, land owner; John Needham, Attorney for Mrs. Simpson; AzelI Adams and Virgil Sturgeon, representing Frenchmans Bay Realty Corp.; Albion Derr, land owner; Carl Simpson, land owner; Harry Dalton, representing Furbush—Roberts Company; James white, Treasurer of Bangor Real Estate Development Company; Charles Law, an Interested spectator, and James Mac Leods City Engineer, The City Engineer read the council order authorizing the procedures to be followed for the acquisition for the necessary easements on sewer right—of—ways, then the various property owners were advised as to the est [mated amount of assessments which may possibly be levied on the basis of 75% of the cost being assessed against the property benefited. Damages to be allowed for the property involved for the sewer easement were considered on the basis of the land values as established by the Assessing Department for assessing purposes, and this value averages about four hundred dollars ($4001 per acre for the land In this area. Mr. Harry Dalton, representing Furbush—Roberfs Company and Mr. Adams and Mr. Sturgeon, representing frenchmans Bay Realty Company were concerned about the loss of this land to be taken for sewer purposes since a considerable area could not be used for the construction of any building. Because of these ob— jections, it was agreed that the sewer across these particular parcels of land would be located as close as possible to the railroad right-of—way, thus reducing the land area that could Act be used for building purposes. Mrs. Barbara Simpson and Mr. Carl Simpson both were disturbed about having to pay a sizeable sewer assessment since the location of the sewer as planned wl 11 be at the back end, or rear, of their property and thus the fartheresf away from the available highway. Both these property owners felt that the sewer assessments for this sewer construction should not be assessed at all ands if this were the case, they would make the right—of—way available without cost to the City. Mr. James White objected to the location as planned since this location cut diagonally across a large area of the land which Iles between the property being developed and the railroad right—of-way and it was his opinlon that this location would not be advantageous to the full development of the area. The City Engineer agreed that additional engineering studies would be made to see if a more desirable location could be developed. These studies have been completed and a new location has been planned within the limits of the Bangor Real Estate Development Company area such that the sewer now will be located along the center line of nDn Street as dedicated, and westerly of and adjacent to the spur track righi—of—way serving the Bangor Real Estate Development area. While this location Involves a longer sewer installation, estimates indicate that the cast will not be much greater than the original location planned since the sewer will not be as deep In the ground. This location will serve the development area more advantageously and is agreeable to Mr. White. All of the people present were concerned about having to pay assessments on this sewer construction. They were advised the City Engineer would suggest, that when this construction is authorized by the City Council, provision be made to make payment of these assessments due at such time as the owner or occupant of the land requested entry Into the sewer, provided that each owner would furnish the City Engineer with a recordable Instrument to Indicate that a sewer assessment was outstanding against the property. This policy has been followed on several occasions In the oast and, therefore, is not establishing a precedent. The meeting adjourned at 11:40 A. M. ORDER, Authorizing the City Engineer to Proceed with Acquiring Easements Across Private Property for the Construction of a Sanitary Bawer from Hilfreth Street to the Odlin Road. By the City Council of the City of Bangers ORDERED, THAT WHEREAS the Water Improvement Commission of the State of Maine has ordered the City of Bangor to discontinue the discharge of effluent from the sewage disposal tank on Hildreth Street into the water shed area of the Soutcabscook Stream and WHEREAS the plans for ouch corrective work have been completed by the Engineering Department of the City and WHEREAS the location of the trunk sewer for this corrective work must of necessity cross private lands and WHEREAS attempts to obtain easement across these private properties have not been completely successful, now THEREFORE, the City Engineer is hereby authorized, acting for and on behalf of the municipal officers, to proceed with acquiring the easements in accord- ance with the provisions of P. A S. L. 1911 C. 236 and such further procedures relating thereto as are provided for in the general laws of the State wf Ma 1ne, and he 1s further ORDERED to report his findings to the City Council for further action.
