ORDERED,
THAT WHEREAS, a petition for street construction on a section of
Hewey Street from Buck Street, 450 feetvesterly. and
WHEREAS. the petitioners have signified their willingness to pay
their proportionate share of the cost of such new construction,
NOW, THEREFORE, BE IT ORDERED that the attached petition
for the acceptance of the above mentioned section of Howey Street be received,
and be it furthe r
ORDERED, that said section of Hewey Street be placed on the Official
Map, and be it further
ORDERED, that the City Engine acting for and on behalf of the
municipal Officers according to law lay outer
metes and bounds and establish
grades for said portion of Hewey Street and be it further
ORDERED, that the City Engineer report he findings together with
said description to the City Council as well as an estimate of cost Of such con-
struction, and a list of possible assessments, said report end description to
become a part of this order and be it further
ORDERED, that the portion of said Hewey Street so described in the
Engineers report be hereby accepted as a public way.

Street, respectfully request that Hewey Street be constructed,
in accordance with the requirements of the Ordinances of the City
oI Bangor and that we agree to pay our proportionate share of the

Pursuant to Council Order A60 -M requesting the acceptance of
Newey Street between Buck Street and Brigham Street and in which
the majority of the property owners agreed to pay their proportion-
ate share of the coat of the construction o8 Newey Street, the
following report on the costa of the construction is submitted:
The proposed construction includes excavating the roadway to
the subgrade level, hauling and placing base gravel and surface
gravel, and applying a surface treatment of tar, for a total
estimated cost of three thousand seven hundred ten dollars ($3,710).
Of this total estimated cost, one-third, or one thousand two
hundred thirty-six dollars and sixty-seven cents (E1,236.67) shall
be assessed against the adjacent property benefited. A list of
possible assessments follows:

Description of Essay Street
Beginning at a point on the westerly side line of Buck Street,
said point also being seven hundred and eight and seventy-eight
hundredths (708.78) feat southerly from the intersection of the
southerly side line of Seventh Street and the westerly side line of
Buck Street measured by and along the westerly side line of said
Buck Street; thence southwesterly at an angle of 900 from the wast-
erly side line of Buck Street to the easterly side line of Brigham
Street as proposed, a distance of four hundred seventy (470) feet.
The street has been laid out fifty (50) feet wide measured at right
angles southeasterly, and over the same course and within the same
bounds as originally set aside for street purposes by the proprietors
of the land over which said street passes.
GRADE
A grade for the proposed street was established as follows:
Beginning at a point formed by the center line of the proposed
street and the westerly aide line of Buck Street at station marked
0 3 0 as shown on the accompanying plan, elevation 114.10 feet;
thence proceeding in the following manner:

All elevations refer to and era established from the City of
Bangor datum.
The meeting which was held in the office of the City Engineer
at 10:00 A. M., EST, on December 7, 1959 was adjourned until 7:30
P. M., EST, on December 9, 1959 at the same place. There appeared

at this meeting, 1n addition to the City Engineer and City Solicitor,
the following residents: Scott B. Johnson, George H. Millet, N. E.
Vetters, John T. Shields, Clifton H. Chapman and Dominick Meucci.
All of the above persons except Dominick Meucci had been notified
by mail of the meeting and had been advised of the estimated amount
of the assessment which would be levied against the property as their
proportionate share of the seat of the construction of Hawey Street.
All these property owners objected to paying the amount of the asti-
mated assessment which was based an one-third of the coat of the
construction. This amount was somewhat higher than they had anti-
cipated and they all indicated that they would be willing to pay an
assessment on the basis of one dollar (¢1.00) per foot front.
Mrs. Frances A. Weston, also a property owner on Hewey Street,
sea unable to be present at the meeting but a letter written by
her was addressed to the City Engineer's office in which she ob-
jected to any assessment, feeling that it was the City's responsi-
bility to provide suitable street areae aid, since she had been a
resident on Hawey Street for some thirty years or more, she did
net feel it was fair or just to be assessed for the construction of
the street at this late date. The meeting was adjourned at 8:40
P. M., FST.
If the City Council decides to approve the assessments on
the basis of one dollar ($1.00) per foot front, the majority of the
property owners are in favor of the construction end acceptance.
If, on the other hand, the decision is to make the assessment on
the basis of one-third of the wet of the construction, then the
majority of the property owners are opposed to the construction
and the acceptance of the street as a public wap.

A meeting was held on December 21, 19$9 by the Public Works
Committee of the City Council for a further consideration of
the acceptance of Newey Street. Present at this meeting were
the three members of the Public Works Committee of the City
Council{ Mr. Charles Higgins, Chairman, Dr. Carl Blaisdell and
Mr. Edgar Keith, members, City Manager, City Engineer, and Mr,
Scott Johnson and Mr. Clifton Chapman, representing the property
owners on Howey Street. After much discussion, the two residents
present indicated that the majority of the property owners would
be willing to pay their proportionate share of the coat of the
construction of this street.
The Planning Board has recommended that the street be
accepted as a public way and the City Engineer recommends that
the street as described be accepted and the grades as listed be
established and that the street be named and known as Newey Street.
