And that the said City Engineer met at thetime and place of meeting specified in the notices and proceeded to try out. said sewer easements or rights of way as follows: Report of City Engineer Description Page 2 Beginning at a granite monument set in the ground on the westerly side line of Valley Avenue, said manument being about 280 feet northwesterly from the northerly side line of Holland Street, said monument also being at Ste. 77 1 30 as shown on City of Bangor Plan kS-626 Sheet 15; thence northwesterly on a bearing of N 830-15' W for a distance of 230 feet; thence northwesterly on a bearing of N 370-45' W for a distance of 143 feet; thence northwesterly on a bearing of N 500-45' W for a distance of 225 'feet; thence northwesterly on a bearing of N 310-15, for a distance of 378 feat; thence northwesterly on a bearing of N 620-15' W for a distance of 367 feet; thence northwesterly an a bearing of N 880- 15, W for a distance of 85 feet to the existing trunk sewer adja- cent to the southerly right-of-way line of Interstate Highway 95. Also that portion of the sewer installation crossing Kenduakeag Stream between Ste. 86 i 20 td Ste. 88 i 65 and extending north- easterly on a bearing of N 7 301 E a distance of 245 feet. The above description refers to that portion of the center line of the proposed new interceptor sewer which crosses lend owned by the S. A. Maxfield Company and land owned by the Roman Catholic Bishop of Portland (Mt. Pleasant Cemetery). The limits of the right-of-way area across the property of the S. A. Maxfield Company land shall be 25 feet and 15 feet westerly and 25 feet easterly from said center line excepting the area occupied by a small frame building located near the dividing line between the Maxfield lend and the cemetery land and containing 11,296 square feet, or 0.259 acres. The limits of the easement area over the cemetery property to be 25 feet westerly from the described center line and to extend easterly to the low water mark of the Kenduakeag Stream. Also to include that portion of the sewer installation crossing the stream between Ste. 86 4 20 and Sta. 68 4 65 extending from the low enter mark on the westerly aide of the stream to the thread of the stream a distance of about 105 feet and to be 50 feet wide measured 25 feet at right angles each way from the above described center line. The whole area containing 64.082 square feet or 1.470 acres, all as shown on City of Bangor Plan S-626, Sheets 15 and 16. Also a third easement area crossing land owned by Curtis Hutchins described as follows: Beginning at a point on the easterly aide line of Valley Avenue, maid point being about 400 feet southerly from the southerly right-of-way line of Interstate Highway 95 and at Ste. 1 { 25 as shown on City of Bangor Plan S-626, Sheet 16; thence northeasterly on a hearing of N 709-153 E for a distance of 210 feet; thence Southeasterly on a bearing of S 410-15' E for a distance of 163 feet to a point 25 feet beyond the existing Arctic Brook trunk sewer. The above description refers to the center line of the proposed new inter- ceptor sewer and the right-of-way to be 50 feet w ids measured 25 feet at right an lea each way from the described center line and containing 18,750 square fset or 0.430 scree, all as shown on City of Bangor Plan S-626, Sheet 16. Report of City Engineer Page 3 Prior to the time set for the meeting, written notices were mailed to all the property owners across whose land the proposed sewer Installation crosses and they were invited to be present at the meeting. There appeared at the time and place set for the meeting, Mr. John T. Quinn, representing the Roman Catholic Bishop of Portland. The proposed plan for the new sewer was explained to him and he was provided with an attested copy of the Council Order, copy of the letter to the Catholic Bishop of Portland advising of the meeting and a complete set of plane for the sewer project. Prior to the time of the meeting, Mr. Russell H. Peters tele- phoned informing us that he was representing Mr. Curtis Hutchins and advised that Nr. Hutchins would not have any objections to the easement over his land. Mr. Michael Pilot telephoned stating that he was representing the S. A. Maxfield Company And that he would not be able to attend the meeting and requested that the City Magineer call an him at his office and provide detailed ex- planation. This information and a plan showing the area needed for the sewer right-of-way has been given t o Mr. Pilot. The amount of damages, if any, which may be claimed by the property owners was not discussed at the meeting. At a later con- ference, Mr. Quinn was advised of the amount of damages to be re - commanded for the easement over the cemetery property and he indi- cated he would advise the proper authorities of the recommendation. No objection to this recommendation has been received. The S. A. Maxfield Company will be inconvenienced to a certain extent while the sewer is being installed across their property and they will not have access to the storehouse for a few days during the construction of the sewer. This storehouse Is used for the storage of lime, sulphite and some wool and access is needed at least every three or four days. The location soroes the cemetery property is Adjacent to the west bank of the Renduakeag Stream and a portion to the center line of the stream. A good part of this area is inundated when high water prevails, especially in the spring and part of the area is covered with tress and wild growth. After the sewer hes been in- stalled, it will be necessary to build a gravel roadway over the sewer location to provide access for inspection and maintenance. This roadway can also be utilised by the cemetery for access to their land after construction has been completed and this access will be a benefit to the cemetery location of the sewer across the land owned by Curtis Hutchins will not interfere with any possible future development of the land. Report of City Engineer Page 4 In recent previous takings for sewer right -o£ -way needs, a value of four hundred dollars (4400) per acre has been estab- lishad-es a fair value £er-damages on raw or undeveloped land. Accordingly, it is rece coded that this value be used as a basis for dosages on the right-of-way needs for this section of the Ren- duskeag Street interceptor.
