To: The Municipal Officers
Pursuant to City Council Order #158-J, passed July 229 1957
as amended, directing the City Engineer to lay out and proceed with
the construction of a new sanitary sewer to serve the Industrial
Park area and extending from the City Farm trunk sewer near Farm
Road througb the Industrial Park area to the Odlin Road and thence
to and along a portion of relocated Hammond Street, the following
report is submitted.
This Job was
awarded to Hughes Bros., Inc., the lowest of
several bidders,on Sept. 199 1957 and work was started on Sept. 23,
1957• The project was finally completed after innumerable delays,
on Sept. 202 1960 with final settlement of all claims and disputes
on Aug. 2, 1961.
The total length of the sewer as completed consists of 8,148
feet of 18" reinforced concrete pipe, 692 feet of 12" vitrified
clay pipe, 2,168 feet of 8" vitrified clay pipe, together with 30
manhole ventilators. Total cost of this project amounted to two
hundred forty-one thousand four hundred sixty-seven dollars and
fifty-nine cents (1241,467.59). Of this amount, 75%, or one hundred
eighty-one thousand one hundred dollars and sixty-nine cents
(1181,100.69) may be assessed against the property benefited.
A total coat for assessment purposes based on using 12" pipe
in place of the 1811 pipe has been figured and is shown ea follows:

Separate sheets are attached hereto and made a part of the
report on which is shown a list of assessments based on three sep-
arate determinations. The first list is based on 75% of the actual
cost of the project.
The second list is based an 75% of the cost of the project bad
1211 pipe been used in place of the 1811 pipe. This procedure is in
accord with established policy.

The third list is based on the revised rate used in the
supplemental report for figuring assessments on the Mildreth
Street trunk sewer project. This third list is suggested as
the basis for possible assessments such that the abutting
owners would not be penalized by the excessive coats on the
Project due to the inefficiency and ineptitude of the contractor.

The various recormrended lists of assessments were thoroughly
discussed and the entire history of the project was completely re-
viewed. From this, it 1s recommended that established policy be
followed and that the assessments listed int the report based om the
cost of the project had 12" pipe been used in place of the larger
sizes be approved for the record except that the assessment against
abutting owners who previously have been granted the right to enter
the sewer shall be levied and become due when billed. The payment
of all ether approved assessments to be deferred until such time as
the owner or occupant requests a right of entry into the sewer at
which time the assessment will be lawfully levied and shall be paid
before entry is granted.
As a condition for the deferment of payment, each property
owner shall deliver to the City Imgineer a recordable instrument
showing the smount of approved assessments as ma outstanding lia-
bility against the property. Failure on the part of any property
owner to deliver the recordable instrument within 60 days of Council
approval shall be cause for the assessment to be lawfully levied mrd
thus become payable according to law.

To: The Municipal Officers
On December 1, 19619 the City Engineer submitted a report to
the City Council Order #33-P showing the coat of the construction
of the Industrial Park trunk sewer, together with lists of possible
assessments. A public hearing on the assessments was held by the
City Council on Dec. 11, 1961. Following the public hearing,
Order d33 -P was referred to the Public Works Committee for further
study.
The Public Works Committee met on January 9, 1962 with the
property owners and their representatives relative to the proposed
assessments. Various aspects of the problem was discussed at this
meeting and the Public Works Committee voted to give the problem
additional study and meet at a later date to make a final recom-
mendation.
On Januery 16, 1962, the Public Works Committee met again
end, after due consideration, voted to recommend to the Council
that the assessments against the property benefited be based on
the same cost per foot front which were approved for eases sments
on the Hildreth Street trunk sewer extension and that this amount
be approved for the record but that the payment of these assess-
ments be deferred until such time as the owner or tenant requests
a right of entry into the sewer, at which time, the assessments
will be lawfully levied and became payable before entry is granted,
except that the assessments against owners to whom entry has been
granted shall be considered lawfully levied and shall become pay-
able in accordance with the law.

and, accordingly, the assessments are hereby lawfully levied.
The second list shows the owners and the mounts of assessments
that are approved for the record but which are not to be lawfully
