RESOLVED, WHEREAS, under the provisions of Title I of the Housing Act of
1949, as amended$ the Housing end How Ficance Administrator is authorised to provide
fLanelal assistance to local Public Agencies for undertaking and carrying out urban
renewal projectel and
WID.RFAS, it is provided in such Act that contracts for financial aid thereunder
shall require that the Urban Removal Plan for the respective project area be approved
by the governing body of the locality in which the project is situated and that such
approval include findings by the governing body thate (1) the financial aid to be
provided in the contract is necessary to enable the project to be undertaken inccord-
ce with the Urban Renewal Plant (2) the Urban Renewal Plan will afford mav�mmoppor-
tunity, consistent with the sound needs of the locality as a Mole, for the rehabilitation
or redevelopment of as urban ranewcl area by private snterpriee; and (3) the Urban Re-
newal Plan conforms to a general plan for the development of the locality as a Mole; and(y,
the Urbea Renewal Plan gives due consideration to the provision of adequate park and
recreational. areas and facilities, as my be desirable for neighborhood improvement, with
special consideration for the health, safety, and welfare of children residing in the
general vleiwity of the site covered by the Plan; and

has entered into a planning contract for financial assistance untler such Act with the
United States of America, acting byand thio4gh the Housing and Home Finance Adminio-
trator, pursuant to which Federal funs were provided for the urban renewal project (here-
in called the "Project") identified as "Stillwater Park Urban Renewal project" an en-
compassing the "a& bounded by the south but W. Hope Avenue, on the north by Stillwater
Avenue. on the east by the rear Sot linea of the properties fronting on the east aide of
Dartmouth Street, and on the west b the rear lot lines of hies fT! an the
west aide of Birch Street,'in the City of Bangor, State oI Raine, herein called the
"Locality" :end

WHERZkS, the local Public Agency has made detailed studies of the location,
physical condition of structures, land use, envlronwental influences, and the social,
cultural, and accrete conditions of the Project area and has determined that the area
is a blighted area and that it is detrimental and a menace to the safety, health, and
welfare of the inhabitants and more thereof and of the locality at large, because of
Agency and are aware
WHEREAS, there has been prepared and referred to the City Council oP the City of
Bangor (herein called the "Governing Body") for review and approval an Urban Renewal
Plan for the Project area, dated Becesder7. 1961, and consisting of 16 sed
14 b ;&bite (and supporting cocoanut, a Relocation Plan, entitled "Relocation
Report^ Code No. Re223 containing proposals for relocation as submitted with Final
Protect Report) supported by the following suppleeentary, material, data, and raw®®—
&tione, which material, data, and reconnandatiens are not a part of said Urban Renewal
Flan; and
WHERERS, said Urban Renewal Plan has been approved by the Governing Body of the
Local Public Agency, as evidenced by the copy of said Body's duly certified resolution
approving said Urban Renewal Plan, which is attached thereto; and
WHEREAS, a general plan hoe bean prepared and is recognized and used as a guide
for the general development of the Locality as a whole; and
WMMPAS, the Reactor Planning Boardwhich in the duly designated and acting official
planning body for the Locality, has submitted to the Governing Body its report and
recanterniatione respecting said Urban Renewal Plan for the Project area and has certified
that said Urban Renewal Plan conforms to the said general plan for the Locality as a
whole, and the Governing Body has only considered said report, recosseendatione, and
certification of the planning body; and

whEalASO said Urban Rssewal Plan for the Project area prescribes certain land
ae for the Project area and will require, among other things, (the vacating and
®oval ar streets, allays, and other public ways, the establishment of new street
patterns, the location and relocatian of sewer and water shine and other public fao
ilitias, and other public action); and
WHEREAS, the meal Public Agency has prepared and submitted proposals for the
relocation of fannies that nay be displaced as a result of carrying out the Project
in accordance with said Urban Renewal FLan; and
hNFRHAB, there have also been presented to the Caverning Body SKarmation and
data respecting the proposals for relocation which have bean prepared by the Local
Public Agency as a result of studies. Surveys, and inspections in the Project arm
and the ass®bling and a,alysie of the data and information obtained from such studies,
aurveys, and inspections; and
WHEREAS, the members of this Governing Body have general knowledge of the condi—
tions prevailing in the Project area and of the availability of proper housing in the
locality for the relocation of families that may be displaced from the Project area
and, in the light of such knowledge of local housing conditions, have carefully coo—
sidered and reviewed such proposals for relocation} and
hEEFRAS, it is necessary that the Governing Body take appropriate official action
respecting the proposals for relocation and said Urban Renewal Plan for the Project,
in conformity aith the contraat for financial assistance between the Local Public Agency
and the United States of Aaerica acting by and through the Housing and HMO Finance
Adsiniwtrator:
NCi, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TO CITY OF EANGCRx MAINS
AS ML S:
1. That it is hereby found and deternlnad that the Froject is a blighted area
and qualifies as an eligible Project area under Chapter 168 of the Private soul
Speeial Iowa of Naive 1957•
2. That Said Urban Renewal Plan for the Project aforementioned, having bass duly
reviewed and considered, is hereby approved, and the City Clark be and is hereby
directed to file said copy of said Urban Renewal Plan with the shutes of this
meeting.
3. That it is hereby found and determined that said Urban Renewal Plan for the
Project area conforae to said general plan a the Locality, add is feasible.
q. That it is hereby found add deter®ned that the financial aid provided and to
be provided pursuant to said contract for Federal fintancial assistance pertaining
to the Project is necessary, to enable the Project to be undertaken in accordance
with the Urban Renewal Plan for the Project area.
5. That it is hereby found and determined that the above-mentioned Urban
Renewal Plan Ior the Urban Renewal Area siil afford maxims opportunity,
consistent with the acted needs of the Locality as a Mole, for the urban
modeal of each areae by private enterprise.
6. That it is hereby faced and determined that the Urban Renewal Plan for
the Urban genteel Area gives due consideration to the provision of adequate
park and racreatiorel areae am facilities, as may be desirable for neighbor-
hood improvement, with special consideration for the bealth, safety, and
welfare of children residing in the general vicinity of the site covered by
the Plan.
9. That it is hereby found and determined that the proposals for the proper
relocation of the families displaced in carrying out the Project in dent,
safe, and sanitary dwellings in conformity with acceptable standards are
feasible and can be reasonably and timely off acted to permit the proper pro -
mention and completion of the project; and that such dwellings or dwelling
units available or to be made available to such displaced fandlies are at
least equal in comber to the comber of displaced families, are not generally
leas desirable in regard to public utilities and public aM cottercial faci
ties than the dwellings of the displaced families in the Pro,7ectar
available at rants or pries, within the financial means of the displaced e
faa lime and are reasonably accessible to their places of mployment.
8. That in order to implmant and facilitate the effectuation of the Urban
Renewal Plan hereby approved it is found and determined that certain official
action must be taken by this Body with reference, mong other things, (the
vacating ani rmoval of streets, alloys, and other public ways, the eatablim-
mmt of new street patterns, the location and relocation of cover sued water
main and other public facilities, and other public action), and, a ordingly
this Bohereby: () pledges its cooperation in helping to carry out such
Urban Reamal Plan; (b) requests the various officiate, depmtments, boards, '
Body
and agencies of the Locality having administrative reeponaibilities in the
premises likewise to cooperate to such and and to exercise their respective
functions and powers in a manner consistent with said Urban Renewal Plan;
and (c) 6snds ready to consider and bake appropriate action upon proposals
and measures designed to effectuate said Urban Renewal Plan.
9. That financial assistance under the provisions of alle I of the Housing
Act of 1949, as Awarded, i. ma
necessary to le the land in the Project area
to be renewal in accordance with the Urban Roussel Plan for the project err
and, accordingly, the filing by the local Public Agency of an application en
applications for such financial assistance under said Title I is hereby approved.
CERTIFICATE OF RRCCRDING OFFICER
The undersigned hereby certifies that:
1. He is the duly qualified and acting City Clerk of the City of Bangor,
Rain@, (herelmfter ealled the "Locality"), and the vustoddad of the records of
the Lomiity, including the minutes of the proceedings of the City Council (here-
inafter

certificate.

the Rl@RFAS clauses, adopted at a meeting of the Governing Body held on the

denced by a duly certified resolution of that body attached to said Plan, presented
at said meting, and approved by the Resolution of the Governing Body.
4. the Resolution a the Governing Body has been duly recorded in the minutes
of said meeting and is now in full force and effect.
5. Said meeting was duly convened and had in all respects in accordance with
law and the bylaws of the Locality. To the extent required by law or amid bylaws,
due and proper notice of said meeting was given. A legal quonm of members of the
Governing Body was present throughout said meeting, and a legally sufficient number
of members of the Governing Body voted in the proper mamnm for the adoption of the
Resolution of the Governing Body. All other requirements and proceedings under lav,
said bylaws, or otherwise, incident to proper adoption of the Emulation of the
Governing Boor, including any publication. it required by law, have baso duly ful-
filled, carried out, and otherwise observed.
6. If the Beal appears below, it constitutes the official seal a the Locality
and was duly affixed by the undersigned at the time this certificate was signed.
