WHEREAS, the Sawyer Environmental Recovery Facility Ispresentlyprocessing
closure plan with the Department of Environmental Protection for the solid
waste and ash landfill located in the Town of Bearden, which presently accepts
the incinerator ash from the Penobscot Energy Recovery Company facility in
otrington: and
WHEREAS, the future disposal of leachate from the landfill after closure is
a concern of all area citizens; and
WHEREAS, direct piping of the leachate to a suitable wastewater
water treatment
plant is considered to be the beet environmental solution for future leachate
disposal; and
WHEREAS, the City of Bangor Wastewater Treatment Plant offers the only
opportunity for the direct piping of leachate from the Landfill;
NOW, THEREFORE, BE IT RESOLVED, TEAT the City Council ddd} hereby OAp}df/
txp authorises appropriate City staff to further investigate the passible
fu[ conveyanceof the leachate to the Bangor Wastewater Treatment Plant
by direcpiping from the Sawyer Landfill, said leachate conveyance to be
subject to the following conditions:
1. That the leachate is determined to be in compliance with Bangor's
Industrial Pretreatment Ordinance, to assure that it does not have any
adverse impacts
an
effluent limitations, the operation of the Wastewater
Treatment Plant or [that it will not ultimately downgrade the quality of the
compost produced from sewage sludge.
2. That adequate pretreatment of the leachate, if necessary. will be
completed by others prior to introduction of the leathers into the sewer
system.
3. That the acceptance of said leathern at the Bangor Wastewater Treatment
Plant meets with the approval of the State of Maine Department of Environmental
Protection and the B.S. Environmental Protection Agency.
6. That a subsequent alternative disposal plan will be provided in the
inent that the leathers does not meet acceptable standards for Introduction
to the Bangor sever system.
5. That reasonable compensation can be negotiated for the monitoring,
testing and other operational coat pertaining to treatment of the leachate
at the Bangor Wastewater Treatment Plant.
6. Appropriate financial support from Sawyer Environmental Recovery
Facility to cover the upfront costs associated with analyzing this request.
AND DE IT FURTHER RESOLVED. THAT this authorization does not constitute or
Imply agreement by the City of Bangor to at sept such leachate n or in the

future. Staff shell report the results ofthese investigations t the City
Council upon their completion and no contract between the City of Bangor and
Sawyer Environmental ahall be entered Into without formal approval of the
City Council.

Svbjecn Leachate from Sawyer Landfill
The staff at the wastewater Treatment Plant has learned that
Sawyer Environmental Recovery Facilities has apparently submitted a
closure plan for the landfill In Hampden, which proposes [ rept
the leachers from the landfill and tie It Into the Bangor to
Plant, I presume by way of the Bampden a system. The application
apparently proposes to pay Bangor 6.01 per gallon for the leachers
received. -
The staff hassome serious concerns
about this proposal, since
it could have very detrimental effects on r future effluent limits
and could also jeopardize composting operation. The Sawyer
landfill was originally operated as a MSW landfill, but its primary
product at the present time i incinerator ash; there is, o
t
separ receiving s
facility fox asbestos. It i not known whether
or not any other toxics have been stored on the site. Any c -
orations of toxics or heavy metals could virtually wipe our our
composting operation.
Last week, I talked to Tom Sawyer, and he confirmed that the
closure application provided for connecting into the sewer
system.
He indicated that the application actually includes the filling of
the "deep ditch", which will provide for the additional ash capacity
that weneed in the Interim for the PERC plant. Once the landfill i
closed and capped, then it Would appear that the burden of any further
pollution will end up at the Bangor Wastewater Treatment Plant, and it
may continue indefinitely. This z the entire burden from Sawyer
and places it on the City, which Ie feel is unreasonable.
As an alternative. I would suggest that the leachers be
intercepted by a holding tank and that active and continuous
pretreatment facilities be provided and operated to assure that the

leachers is treated to the a azy to protect the quality
of the treatment plant Influent before being discharged into the
sewer

system: the City of Bangor should r the right to disconnectthe
sewer the holding tank at any time ¢inthe future if the leachate
is found to be in noncompliance. i also feel that this issue should
be brought to the attention of the City Council in the near future.

Subject! Sawyer Landfill Leachate
This mmo is written as a follow-up to my memo dated August 20,
1991 regarding the possible future tie-in of ato the Bangor
sewer system, to carry leachate from the SaWersewer
Landfill located in
Hampden.
In my original memo, I expressed concern
as to the possible
effects that the leachate might have on either the operation of the
Treatment Plant or the production of clean compost.
I believe that for many reasons,
, political, environmental,
and technical, i would makes eto it into the Bangor sewer
system, and I would recommend that Bangor pursue this approach provided
that we can be absolutely assured of future protection against problems
with treatment. It is my understanding that a committee from Hampden
is examining the expansion and closure of the Sawyer Landfill, and the
future handling of the leachate is one
s
of the issues that they are

considering. Sin a have all tried to work ina cooperative and
n
responsible m with regard to the disposal of solid waste, then
I think that we should thoroughly examine the issues pertaining t
the treatment of the leachate.
Some of the Issues that need to be studied are as follows:
1. The leachate needs to be tested, to determine the extent
of pretreatment necessary to introduce it into the Bangor s system,
to assure that it does not have any adverse impacts on our effluent
limitations or the quality of aur sludge compost.
2. We need to obtain cement and approval from both DEP and
EPA.
3. Provisions will be required for ultimate disposal in the
event the leachate becomes untreatable, or is not properly managed at
the landfill.
d. We should develop a model contract agreement which could be
used to govern future compliance.
5. We should determine anable cast for handling the leachate,
including necessary future monitoring costs.

Crmmemary:
The proposed closure plan for the Sawyer Landfill is presently being
reviewed by PER, as well as a Committee in the Town of Hampden. The
closure plan does provide for additional capacity for incinerator Bah
s part of the final contour of the Landfill, which will provide for
needed additional capacity for PBRC.
From and environmental standpoint, disposal of the leachate by direct
piping to a public wastewater treatment plan[ is considered to be the
best option, which will assure that the environment is not violated in
future generations after the Landfill has been closed and virtually
abandoned. -
It should be noted that there a conditions attached to the
Council's support of the Resolves which should have satisfactory answers
before the development of a formal contract agreement for accepting th
leachate.
This Resolve is recommended for passage.

plant is considered to be the best envireyes ental solution for future Teachers
disposal; and
WHEREAS, the City of Bangor Wastewater Treatment Plant offers the only
opportunity for the direct piping of leachate from the Landfill;
NOW, THEREFORE, Be It
RESOLVED, that the City Council does hereby support the future conveyance
of the Teachers to the Bangor Wastewater Treatment Plant by direct piping
from the Sawyer Landfill, subject to the following conditions;
1. That the leachate is determined to be in compliance with larger's
