Responsible DePertment; Planning Division Commentary: ' The Planning Board held a public hearing on the above zone change request at its meeting par July 5, 1989. , John Vogell, the applicant, spoke in favor. No one spoke in opposition. After considerable discussion regarding the moratorium in the Stillwater Avanue/Bangor Mall area, the Board voted wasumouely to continue this item for 30 days. The Bound discussed this done change request at its meeting of August 7, 1989. No one spoke in favor of or in opposition to the requested change. Dae to the moratorium in this area, the Board voted five in favor and none opposed to re omeenu d to the City Concil that this done change request be indefinitely postponed. Thisparcelis located approximately 1500 feet north of the Stillwater Avenue and Hogan Road intersection in an area w which lacks either s v water s As theBoard knows, there has been argreat deal of dizcussien about sewer extension into this area of the City in recent weeks. Also, the City is in the process of developing a subarea plan for the future development and service of the greater Mall area. b. While the parcel is on the edge of thea a that is indicat- ed for future commercial u n the City's Land Use Plan, it does appear premature to change the Agricultural zoning to an urban density at this time. (For example, it i not entirely clear what the zoning requirements area C-2 Zone for a parcel which had On-site waste disposals) In most cases when commercial zoning is sought, the urban s - vice% are either present or within close proximity. Howev- er, there is no guarantee in this particular location, that City seNer will be available now or e n the foreseeable future.Given the fact that the City is in in a moratorium for any permits in this area and given the fact that the City is reviewing its land use policies and service a policies in this a at this time, it would e .e illogical to change the zoning now. (This i not to sayc that once - service issues and development policy in thea a have been reviewed, this would not turn out to -be a permissible zone change.) i C. Given all the present uncertaintiec as to what may happen i this a and the lack of services to a commercial n development with potentially .high densities, Staff would recommend that this zone change either be denied or that a mutual agreement be reached with the applicant that action be staid until the future use and services in this area be. better defined in the next few months.
