Commentary:
Both David Coutts, representing Bangor Docking Facilities, and Michael
Delong received notice on Friday that the proposed dockage and fuel
facility floats moat be removed within 21 days on the ground that a
Permit has not been issued for their installation. It was the clear
understanding of both parties that, through the efforts of the
Congressional Delegation, permission End been granted to install the
floats. This Resolve is intended to demonstrate to the D.S. Army
Corps of Engineers that the removal of the facilities will have
very detrimental effect on the entire waterfront redevelopment program.

BBBOLVEB. THAT. WHEREAS, the City of Bangor for the past fifteen years
has beenaa
working to redevelop the Penobscot River waterfront a recreational
boating e area to serve as a catalyst in the revitalization of thedowntownarea; and
WHEREAS. the City has spent approximately $1.3 million of local funds to acquire
and dwarfish a number of blighted and underutilized structures in the waterfront area;
and
WHEREAS, an additional $250,000.00 of Federal, State and local funds have been
spent to start the creation
eation of a waterfront park to provide for public access to
the river as well as facilities for local and transient boaters: and
WHEREAS, the number of boat owners using the waterfrontfacilitieshas multiplied
more than five times since 1985 to the point where available mooring apace is becoming
limited; and
WHEREAS, the City Council by Council Order No. 89-54 passed January 9, 1989 has
contracted with Bangor Docking Facility to install and operate seasonal dockage
facilities for approximately 24 boats so as to provide for additional mooring apace
in the river; and
WHEREAS, the City Council by Council Order No. 89 -146 -'passed March 27, 1989 has
also entered into a agreement with Michael Belong to provide R fuel dock t0 serve
recreational boats an
WHEREAS, it las been learned that the O.S. Army Corps of Engineers has ordered
both parties to re the floats within zl days because permits for their instal-
lation have not beenvissued. despite the fact that bath parties had applied for said
permits a number of months ago and had understood that informal permission had been
given to complete the installations: and
WHEREAS, the removal of said facilities will provide extrema hardship on not only
the users of said facilities but also the owners, to the extent that it might not be
financially feasible to rainfall at a later date: and
WHEREAS, said r val will have a detrimental effect upon the City's efforts t0
expand and revitalize the waterfront area,

NOW, THEREFORE, Be It
RESOLVED, THAT the City Council protest the proposed decision of the U.E.
Army Corps of Engineers to require the removal of said facilities and hereby
directs the City Manager or his authorized agent to convey the objections of
the City Council to the Corps of Engineers and to try to Circumvent the need
to remove said facilities.
