Summary
The proposed zone change will amend the zoning of 472 Essex Street from Urban Residence One District
(URD1) to Urban Residence Two District (URD2). The present vacant building was converted to a 4 unit
structure permitted under the 1960 Zoning Ordinance. The property was rezoned to Urban Residence One
(URD1) in 1991, creating a grandfathered, non -conforming use. URD1 is a single family zoning district. If
approved, this zone change will allow up to four units.

ORDINANCE, Amending Chapter 165, Land Development Code, by changing the zoning of 472
Essex Street from Urban Residence One District (URD1) to Urban Residence Two District (URD2).
WHEREAS, the existing building was a four unit building under the City land Use regulations since
the 1960's, and
WHEREAS, the lot size is adequate for a four unit building in URD2 (15,681+/- square feet).
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor is amended as follows:
That the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October
28, 1991, as amended, be hereby further amended as follows:
By changing a parcel of land located at 472 Essex Street (Tax Map No. 45 Parcel 9D) from Urban
Residence One District (URD1) to Urban Residence Two District (URD2); said parcel containing
approximately 15,681 SF +/- and being more particularly indicated on the map attached hereto and
made a part hereof.

SUBJECT: Amending Zoning Ordinance

Urban Residence 2 District (URD -2). Council Ordinance 18-

Please be advised that the Planning Board at its meeting on March 20, 2018,
held a Public Hearing on the above zone change request.
Chairman Charles Boothby asked the applicant or their representative to make a
brief presentation of the request.
Ms. Tanya Emery Director of Community and Economic Development indicated
that the property was tax acquired and there were buyers interested in renovating the
building. It has been vacant for many years, such that the grandfathered units have
expired. The City has two choices; to demolish the existing large structure and sell the
vacant lot, or rezone the property is see if a restoration rehabilitation is possible. Ms.
Emery indicated that if the building were not able to accommodate four units,
restoration is unlikely to be economically feasible.
There were no opponents to the rezoning request.
Planning Officer Gould indicated that the request was to rezone property at 472
Essex Street which was in a Residentail B District from the Zoning Code in 1940-1960,
which would allow a four unit building on 10,500 square feet. Later zoning changes,
along with growth in the City designated this area as single family from 1969 to
present.
Planner Gould noted the Board must balance the Comprehensive Plan goals with
that of the prior nonconformity in making a recommendation.
Member Guerette made a motion to recommend the City Council adopt C.O. #18-137,
amending the Zoning at 472 Essex Street from URD -1 to URD -2. Member Durgi,
seconded the motion and the Board voted unanimously in favor to recommend . 0.
