THAT the City Manager, acting for and on behalf of the municipal
officers, be and hereby is authorized to enter into an Agreement, in a
form approved by the City Solicitor. with Cheryl Simeon, proprietor of
Content To Go at 25 Central Street, regarding the use of portions of the
sidewalk adjacent to said Grummet To Go on Central Street for the placement
of outside eating tables during the summer months of 1989.
AGREEMENT
THIS AGREEMENT executed in duplicate this _ day of May, 1989, by
and between the CITY OF BANGOR, acting by and through its City Manager, as
authorized by the Bangor City Council under Council Order No. and
CHERYL GI%SON d/b/a Gourmet To Go, of Bangor, Maine, the parties hereto agree
As follows:
WHEREAS, Cheryl Wiesen wishes to use a portion of the sidewalk
adjacent to her business at 25 Central Street, Bangor, Maine, on a temporary
basis for purposes of providing outside eating tables for customers of Content
To Go: and
WHEREAS, the City of Bangor has no abjection to such use, subject to
the term$ and conditions contained herein,
NOW, THEREFORE, it is agreed as follows:
[1] Cheryl Yfxaon is hereby granted permission to occupy a portion of
the sidewalk adjacent to said Courant To Go on Central Street, Bangor, Maine,
the area In question being more particularly described on a plan attached
hereto as Exhibit "A" for the sole purpose of providing outside tables for
customers of Contrast To Be, for a term commencing on My 15, 1989 and expiring
on October 15, 1989 during the hours of 9:00 A.M. to 6:00 P.M.
[2] In the exercise of the tights granted herein, Cheryl Nlxson will
net interfere with the use and operation of the area as a public sidewalk.
[3] The rights granted herein shall be under the supervision and
control of the City Engineer.
[4] In the event the City, In Its sole discretion, determines that
further use of the premises under this Agreement 1s not In the beet Interests
of the City of Bangor, the rights granted herein may be terminated upon
twenty-four (24) hours' written notice to Cheryl Wiason, which notice shell be
valid upon delivery to Cheryl Wiason at 25 Central Street, Bangor, Maine.
[5] The rights granted herein shall not take effect until Cheryl
Wiesen shall file with the City Engineer a Certificate of Inauraoce with a
company authorized to do business In the State of Maine providing for
liability Insurance coverage in the gross amount of Three Hundred Thousand
Boilers ($300,000.00) with the City of Bangor as a named insured.
