THAT the zoning boundary lines as established by the Zoning Map
of the City of Bangor dated September 23, 1974, as amended, be
hereby further amended as follows:
By changing a parcel of land located on Pinson Road and Davis
Road (Tax Map No. R-21, Parcel No. 2l from Agricultural Zone to
Residential lA Zone. Said parcel containing approximately 10.319
acres and being more particularly indicated on the map attached
hereto and made a part hereof.
PROVIDED, HOWEVER THAT, in addition to the mandatory conditions
imposed by Chapter VIII, Article 21, Section 11 `.3, Ordinances of
the City of Bangor, said change of zone is granted subject to the
following conditions:
1. The use and/or operation of the subject premises shall
be subject to thefollowing limitations and/or restrictions:
A. Maximum Density - 1.4 units/acre.
B. Open Space to be one contiguous parcel -(4 ac, t)'
C. Open Space to be maintained by a Home. Owner's: Association.
D. No lot shall be less than 15,000 SF.
2. Execution by those parties with an interest is the affected
property of an agreement providing for the implementation and enforce-
ment of all the terms and conditions set forth above and the recording
of said executed agreement in the Penobscot County Registry of Deeds
by the property owner, a copy of said agreement being on file in
the Office of the City Clerk and incorporated herein by reference.
In the event that said agreement is not so executed and recorded
within ninety (90) days from thedate of. passage hereof, this
Ordinance shall become nuI1 and void.

Commentary:
Please be advised that the Planning Board held a public hearing
on the above contract zone change request at its regularly
scheduled meeting on May 1, 1989.
Norman Minsky, Esq. and Larry Van Pherson spoke in favor of
the contract zone change request. No one spoke in opposition.
After consideration of the low density nature of the proposed
residential reuse, the Board voted 4 to.0 in favor of recommending
approval of C.O. ¢ 89-182(As amended)

hereby further amended as follows:
By changing a parcel of land located an. Pinson Road and Davis
Road (Tax Map No. R-21, Parcel No. 2) from Agricultural Zone to
Residential IA Zone. Said parcel containing approximately 10.319
andand being more particularly indicated an the map, attached hereto
made a part hereof.
PROVIDED, HOWEVER THAT, in addition to the mandatory conditions

City of Bangor, said change of zone is granted subject to the

A. 14 lots (manufactured or modular housing)

2. Execution by those parties with an interest in the affected
property of an agreement providing for the implementation and enforce-
ment of all the terms and conditions. set forth above and the recording
f said executed agreement in the Penobscot County Registry of Deeds
by the property owner, a copy of said agreement being on file in the
Office of the City Clerk and incorporated herein by reference, in
the event that said agreement is not so executed and recorded within
ninety _(90) days from the date of passage hereof; this Ordinance
shall become null and void.
