Commenrory: .
The Planning Board held a public hearing on the above zone change
request at its regularly scheduled meeting on December 5, 1988.
After consideration of the proposed use and its comparability
with the City's Land Use Plan, the Board voted 5 in favor and
none opposed to recommend approval of the zone change request to
the City Council.
Two area property owners asked for an explanation of the zone chang
and appeared to be satisfied with the requested change.
No one spoke in opposition. -

Item No. 4: Zone Change - Westland Avenue - City of Bangor - C.O. 889-6
a. The City requests a zone change from Residential 4 Zone to Residential
1 Zone on a parcel containing approximately 47,000 sq. ft, located on
the corner of Westland Avenue and Union Street. The City is making
application on behalf of three single-family homeowners.
b. This parcel was before the Board on two prior agendas as a discussion
item. These three parcels were rezoned in the 1974 Zoning Ordinance
to R-4 from their prior zoning of Residence A (single family). These
parcels have a deed restriction limiting their use tosingle-family
residential. Although the Land Use Plan calls for high-density
residential, the existing use is single family, the deeds restrict
the use to single family, and the land owners desire down zoning to
R-1. Staff would recommend that the Board recommend C.O. p 89-6 to
the City Council for approval.
Item No. 5: Zone Change - Front Street - City of Bangor - C.O. d 89-8
a. Applicant requests a zone change from Commercial 3 Zone and Industrial
3 Zone to Waterfront Development District for approximately 5 acres
of land off Front Street.
The land in question is ownedby the City between Front Street and
the Penobscot River.
b. This area was part of the Waterfront Development Plan prepared this
last year. The Waterfront Development Merrier (the zone which was
designed for the redevelopment of the Waterfront which was adopted in
August)will provide for much more compatible uses than the existing
mix of commercial and industrial zoning, presently in place.
c. Staff would recommend that the Planning Board recommend the proposed
zone change to the City Council.
Item No. 6: Final Subdivision Plan - 435 Kenduskeag Avenue - Morris Far
a. Applicant requests final planapproval for a 45 -lot subdivision located
off Kenduskeag Avenue in a Residential 1 Zone.
b. This subdivision received preliminary plan approval at the November
21, 1988 Planning Board meeting. The final plan submitted is
unchanged from the preliminaryand meets ordinance and submittal
requirements. The final plan submittal and application indicate
that the applicant intends to construct the entire 45 lot, 19.72 acre
subdivision at once and not in phases. Staff would recommend that
bond be posted for the improvements in the subdivision and that final
plan approval be conditioned upon posting bond.
