P32: $10.0a (6) Section 117.4 be deleted and replaced with the following: 117.4 Violation Penalties: My person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure i violation of an approved plan or directive of the cede official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a land use iolation, punishable by a fine a rated in Ch. IN, Section 3(2) R-106 entitled "Civil Penalties." Each day that a violation continues shall be deemed a separate offense. (7) Section 118.2 is deleted and replaced with the following: 118.2 Unlawful Continuance: My person who shall continue any work in or about the structure after having been served with a stop work order, except such work a he is directed to perform to remove violation or unsafe conditions, shall be guilty of a violation of this Ordinance. (8) Section 123.3 is deleted and replaced with the following: 123.3 Counansation of Board of survey: She third member of the board shall receive for his services a fee of $50 to be paid the appellant. (9) Section 124.1 is deleted and replaced with the following: 124.1 Application for Metal: The owner of a building a structure o any other person may appeal to the 'Bangor Board of Appeals", hereinafter designated as the "Board of Appeals," from a decision of the building official refusing to grant a modification to the provisions of this code covering the manner of construction or materials to be used in the erection, alteration or repair o a building or structure. Such appeal shall becommenced on a tam provided by the Director of Code Enforcement together with an administrative processing fee of thirty-five dollars ($35.00). (10) Section 124.2 is deleted and replaced with the following: 124.2 Membership of Board: The Board of Appeals shall consist of five (5) full members and two (2) associate members as appointed by the Bangor City Council. Each member shall serve for three years until such time as a successor has been appointed. Associate members shall serve a three year term or until auccessor has been appointed. All Board members must be residents of the City of Bangor. No member shall serve more than two (2) complete consecutive terve. (11) Section 124.2.1 is deleted and replaced with the following: Ouali£ication of Board Members: Each member or associate member shall be a licensed professional engineer or architect, or a builder or superintendent of building construction,with at laser two years experience, for five years of which that board Member or associate member shall have been in responsible charge of work; and there shall not be more than two (2) maabers or iate members of the board selected from the same profession or business; and at least one of the professional engineers .shall be a licensed structural or civil engineer of architectural engineering experience. Provided, however, that the appointing authority may, at its discretion, appoint not more than one (1) layperson a6 a Somber Or associate member. (12) Section 124.2.2 is deleted and replaced with the fallowing: 124.2.2 Absence of Members: During the absence of a full member or due to conflict of interest of a full member, the Chairperson or presiding officer shall designate a qualified substitute from among the associate members, which member shall hear testimony and vote in place of the full member. Such alternate shall meet the same qualifications asrequired far regular members of the board and while sitting on the board shall have the full power. and authority of the regular member. (13) Section 124.3 is deleted and replaced with the following: 124.3 Notice of Meetings: The Board shall meet upon notice of the chairman within thirty (30) days of filing an appeal or at stated periodic meetings if warranted by the vol me of the work.. (14) Section 124.7 is deleted and replaced with the following: 124.1 Court Review: My person aggrieved by a decision or order of the board may, within thirty (30) days after the decision is rendered, appeal to the Superior Court in accordance with Rule BOB, Maine Rules of Civil Procedure. (15) Section 2906.1 entitled 'Filing," be amended to read as follows: 2906.1 piling: No sign shall be erected, installed, removed, rehung or intained over public property for which a permit is required order the previsions of this code until the sign owner provided proof of the following insurance coverage that is satisfactory to the City of Bangor. A combined single limit for bodily injury, property damage and personal injury liability of $1,000,000 each occurrence and $1,000,000 aggregate, or; Commercial General Liability (Occurrence). A combined single limit for bodily injury and property damage of $1,000.000 each occurrence; $1,000,000 for personal injury liability; $1,000,000 aggregate for products/completed operations; and $1,000,000 general aggregate. Before any work is started the sign owner shall file with the Code Enforcement Department a certificate of insurance containing the following information in respect to all insurance carried: (1) Name of insurance company, policy number and expiration date; (2) The coverages required and the limits on each, including the amount of deductible or self-insured retentions; (3) A statement indicating that the City shall receive thirty (30) days notice of cancellation or significant modification of any of the Policies which may affect the city's interest; and (4) The City as an additional insured. III. Daellina Cade Adopted. In accordance with 30-A N.R.S.A. 5 3003, as amended, the "one and No Family Welling Code," Second edition, 1975, as amended by the 1976 Supplement to Said Code, is hereby adopted and incorporated by reference, as the minimum standard for the fabrication, erection, construction, enlargement, alteration, repair, location and use of detached one and two family dwellings, their appurtenances and accessory structures located within the City of Bangor. Said Code is adopted in its Published farm as is fully set forth herein, except as follows: (1) Sec. R-104t5y. horitq. The Director of Cede Enforcement and Fire Prevention, or his duly authorised representative, are authorised and directed by the City Council of the City of Bangor to administer and enforce all provisions of this Cade. (2) Sec. R-106 Civil Penalties. The requirements of 30-A W.R.S.A. 5 4452 shall apply to the determination of penalties for violations of this Ordinance. The minimum penalty for a specific violation of this Ordinance shall be $100 and the maximum penalty shall be 62,500; provided, however, the maximum penalty may exceed $2,500, but shall not exceed $25,000 when it can be shown that there has been a previous conviction of the same party within the past two (2) years for violation of the same ordinance provision. (3) Sec. R-107 Riche of Annual. Any decision of the Building Official under this Code may he appealed to the Board of Appeals in accordance with Section 124.0 of the Building Code of the City of Bangor. (4) Sec. R-109 permit. A permit shall be obtained before beginning construction, alteration or repair, using application forme furnished by the Building Official. All permit fees shall be the same a established under the Building Code of the City of Bangers (5) Sec. R-114 Definition. For the purpose of this Cede, certain abbreviations, terms, Phrases, worse and their derivatives shall be construed as defined herein. Words used in the singular include the plural, and the plural the singular. Words used in the masculine gender include the feminine, and the feminine the masculine.
