Commentary:
The Permit from the Corps of Engineers authorizes the City to provide
for the regulation of 70 private roarings, as well as the twoprivate
docking facilities in the Penobscot Riveq between the Penobscot Bridge
and the Veterans Remembrance Bridge.
It Is felt that this liar could be placed on the Consent Agenda.

- 1. The docking facility will consist of a 366'x 6' line of
floats running northeast to southwest and parallel to shore eith
two 32'x 8' lines of access floats attached perpendicular to tl'ie

bulkhead. The floats will be reached by a 32'x 3' ramp and will
be secured by steel pipe to the bulkheaded shore, by bottom.

The floats will be reached by a 32'x 3' ramp and will be securell
similarly to the upstream docking facility. The floats will
extend approximately 52' beyond the existing bulkhead.
Approximately 8 boat slips will be provided to recreational
boaters on a first come, first serve, seasonal basis. A fuel
pump. will.be located on the float. Fuel storage will.occur on
the upland.
3. Retain and maintain TO single point moorings in the
riverbetween the, Veteran's Mermorial Bridge and the Old
Penobscot River Bridge. They have bean installed over the .years
since 1982. Individual mooring owners are charged a User fee and
then must place their. moorings order municipal i supervision.

Mooring spaces are assigned on a first come,
lottery basis. Moorings shall be placed inaccordancewith the
special conditions of this authorization.
4. Installand maintain a septic pump out station at the
existing municipal transient/cruise float located immediately
upstream of the docking facility.

2. The permittee shall maintain a fairway through the proill
area and mooring field which shall remain free of structures am
vessels attached to them. This fairway shall be a minimum of
100F in Width.Within sixty (60) days of permit issuance the
permittea'shall provide a plan which shows the final location of
this fairway and the mooring locations or limits of the mooring
field. '

3. This permit is not transferable. In the event the Permittee
discontinues operations the permit shall become invalid and all
worlt must be reill0'/ed. Any new owners shall submit an application
for individual permit, review before performing any work in
navigable waters.
i. This permit aithoiizea encroachments into inactive portions
cf Ghia Penobscot River Federal navigation project. In the event
that the areas involved are needed to support navigation -
activities in the authorized project, this permit shall become
invalid and the encroachments shall be removed by the permittee.
5. within sixty (00) days of permit issuance the permittee shall
provide the Corps with a schedule of mooring and boat slip fees
for the 1990 boating season. The parmittes is responsible for
intaining records necessary to verify that fee schedules are
not aibitraryand for making such records including rules and
regulations available on request of any interested party.
6. The permittee shall .create a waiting list for slip and
mooring space whi<h shall be made available to any interested
party upon request.
T. Future proposals to expand the mooring field are not
authorised until a separate individual Department of the Army
permit is received. _
