Commentary:
The purpose of this item is to start the process for the
acquisition of the Charles Sprague lot, so -calked, located on the
Downing Road, for purposes of expanding the Airport property.
Negotiations to date have not been successful for the direct
acquisition of the property. The Council is requested to adopt
this item. The City Engineer will conduct a hearing on the
proposed acquisition, and report his pecolryrtendations as to damages
back to the City Council for final action at a later date.

ORDERED,
THAT
WHEREAS, by Council Order No. 90-14, passed November 27, 1989, the
City Solicitor was authorized to enter into negotiations with
Charles W. Sprague, Sr. for acquisition of an 8.519 acre
parcel of land in Bangor lying on the northerly aide of
Downing Road; and
WHEREAS, those negotiations have failed to result in an agreed price
for the sale of said property for the City;
BE IT ORDERED THAT the City of Bangor acquire by eminent domain,
pursuant to Title 30-A M.R.S.A. 4 3101, the following -
described property of Charles W. Sprague, Jr., in fee simple:
A certain lot or parcel of land situate in the City of
Bangor, County of Penobscot and State of Maine, more
Particularly described as follows:
BEGINNING at a no. 6 steel rebar set in the northwesterly
line of the Downing Road, so called, at a point 2525 feet,
more or less, from the intersection of said Dcwning Road with
the southwesterly line of Union Street, said rebar defining
the southeasterly corners of land of the Grantor as described
in Volume 2496, Page 93, Penobscot Registry of 'Deeds;
Thence by and along An existing wall and fence along the
common boundary of lands of the Grantor and lands now or
formerly of Muriel B. Downing as described in a deed from
Winifred H. Bachelder to John P. Downing recorded in Volume
1157, Page 58, Penobscot Registry of Daeds, N 360 30' 04° w
a distance of three hundred seventy-one and eleven hundredths
(371.11) feet to a no. 6 steel rebar set at the northerly
corner of said Muriel P. Dawning lands;
Thence N 540 30' 45' E through lands of the Grantor and
parallel with the northwesterly line of Downing Road a
distance of one thousand and fourteen 'hundredths (10000.14)
feet to a no. 6 steer rebar set;
Thence through lands of the Grantor S 360 28. 58^ E to a
no. 6 steel rebar set on the northwesterly line of Downing
Road;
Thence S 540 30. 45' H with the northwesterly line of
Downing Road a distance of one thousand and twenty-two
hundredths (1,000.22) feet to the place of BEGINNING;
Containing 8.519 acres, more or less.
Bearings herein are referenced to Magnetic North, 1988
The description above being based on a survey plan prepared
by the City of Bangor Engineer's Department.
The above-described property is acquired by the City of
Bangor for Airport purposes.
AND, BE IT FURTHER ORDERED, THAT the City Engineer shall and is
hereby directed to give notice of this acquisition to all
interested parties as provided in Title 30-A, M.R.S.A. 5 3101
and 23 M.R.S.A. 55 3022-3023, to conduct a hearing for the
purposes of determining the amount of just compensation to be
awarded for the acquisition of the above real estate, and to
make a report of his findings to the City Council.
