ORDERED, THAT WHEREAS, the presence of 5 or more members of the City Council at a legally called meeting for which there has been proper notice to the public and all members of the Council constitute a quorum for purposes of transacting City business; and WHEREAS, meetings of the City Council are "public proceedings° as defined in 1 M.R.S.A. 5 402(2); and WHEREAS, 1 M.R.S.A. 5 406 provides in relevant part that: "Public notice shall be given for all public proceedings . if these proceedings are a meeting of a body or agency consisting of 3 or more persons. This notice shall be given in ample time to allow public attendance and shall be disseminated in a manner reasonably calculated to notify the general public in the jurisdiction served by the local body or agency concerned."; and WHEREAS, 1 M.R.S.A. 5 401 provides in relevant part that: . clandestine meetings, conferences or meetings held on private property without proper notice and ample opportunity for attendance by the public (shall] not be used to defeat the purposes of this subchapter (1 M.R.S.A. SS 401 at eeq.].ā€¢; and WHEREAS, on occasion, members of the Council find themselves in situations where 5 or more members are present by reason of personal invitation or other notification at a gathering for which no public notice has been given and which does not constitute a legally called meeting of the Bangor City Council, but at which matters relating to the affairs of the City are discussed or considered. Now, Therefore, By the City Council of the City of Bangor, be it ORDERED, THAT the Board of Ethics consider and report back to the Council its conclusions and recommendations as to whether there is a need for additional ordinance standards dealing with the necessity of notice to the public and other members of the Council in situations where 5 or more councilors are invited to attend a meeting or gathering which includes a discussion or consideration of matters relating to the affairs of the City of Bangor.
