AGREEMENT
INSPECTION SERVICES
This AGREEMENT is dated as of the — day of May, 1990 by and
between the City of Bangor (Hereinafter called the "CITY") and
Raymond L. Roy, Sr. (hereinafter called the "INSPECTION SUPERVISOR").
CITY and INSPECTION SUPERVISOR, in consideration of the mutual
covenants hereinafter set forth, agree as follows..
ARTICLE 1. DUTIES
The INSPECTION SUPERVISOR shall perform the following duties.
1. Provide general supervision over three or more construction
inspectors employed by the CITY.
2. Provide direct inspection Of construction activities as
required and in accordance with the City of Bangor
Inspection Services/Onality Assurance Program.
3. Insure that all inspectors assigned to the INSPECTION
SUPERVISOR comply with all requirements of the City of
Bangor Inspection ServiggaIgnality Assurance Program which
is attached and made a part of this Agreement.
4. Report to and communicate with the City Engineer and other
members of the Engineering Department or other City
Department responsible for a Construction project regarding
the scheduled activities and the progress of construction.
The INSPECTION SUPERVISOR shall also immediately report any
unusual circumstances or incidents which cause or have the
potential to cause injury or property damage; contractor
claims or disputes; and all public complaints.

5. Keep a set of marked -up drawings which will be used for the
preparation of as -built drawings, and estimate the
percentage of completion of "lump am" items for the
purposes of reviewing periodic payment requests from the
Contractor.
6. Coordinate any changes or problems with the plans and
specifications, and make recommendations relative to the
processing of any change orders that may be necessary. The
INSPECTION SOPERVISOR shall not authorise any changes in the
specifications without the prior approval of an engineer
representing the City of Bangor.
7. Coordinate construction activities with property owners,
utility companies, the Police and Fire Departments, and
anyone else who may be affected by the construction project.
S. Such other related and reasonable duties as may be requested
by appropriate City of Bangor personnel.
ARTICLE II. TERM OF CONTRACT
The term of this Agreement shall be for a three year period
starting June 1, 1990.
ARTICLE III. PAYMENT
In return for the above services the CITY agrees to pay the
INSPECTION SUPERVISOR the following hourly rates. This rate is a
straight fee based only on hours worked; no other compensation or
benefits will be provided except reimbursement of approved expenses.
First Year $17.50, Second Year $19.00, Third Year $21.00.

ARTICLE IV. WORK SCHEDULE
The INSPECTION SUPERVISOR's work schedule will be coordinated by
the Engineering Department and any other City Department responsible
for a construction project.
ARTICLE V. TERMINATION
This Agreement may be terminated by either party upon 30 days
written notice. CITY agrees that termination will only be for cause
or loss of funds required to pay for the services provided by the
INSPECTION SUPERVISOR.
ARTICLE VI. GENERAL LIABILITY INSURANCE
CITY agrees to provide general liability insurance for INSPECTION
SUPERVISOR during the term of this Agreement.
IN WITNESS WHEREOF, CITY and INSPECTION SUPERVISOR are in agreement
with the above terms and conditions and have signed this Agreement in
triplicate.

INSPECTION SERVICES/QUALITY ASSURANCE PROGRAM
The field inspector/monitor (INSPECTOR) will report to the INSPECTION.
SUPERVISOR (SUPERVISOR) who will be in charge of all field operations
concerning the inspection of most construction projects of the City
of Bangor.
INSPECTOR is CITY's agent at the site, will act as directed by and
under the supervision of SUPERVISOR and will confer with SUPERVISOR
and CITY's ENGINEER regarding INSPECTOR'S actions. INSPECTOR's
dealingsnmatters pertaining to the on-site work shall be i
general be with SUPERVISOR and CITY's ENGINEER and CONTRACTOR keeping
CITY advisedasnecessary. INSPECTOR's dealings with subcontractors
shall only be through or with the full knowledge and approval of
CONTRACTOR. INSPECTOR shall generally communicate with CITY With the
knowledge of and under the director of SUPERVISOR.
Duties and RewRgnsibuLlities of INSPECTOR:
1. Schedules: Review the progress schedule, schedule of Shop Drawing
submittals and schedule of values prepared by CONTRACTOR and
consult with SUPERVISOR and CITY's ENGINEER concerning
acceptability.
2. Conference& and Meet' Attend meetings with CONTRACTOR, such
as preconstructien conferences, progress meetings, job
conferences and other project-related meetings, and prepare and
cirdulate copies of minutes thereof.
3. Liaison:
a. Serve as CITY's liaison with CONTRACTOR, working principally
through CONTRACTOR's superintendent and assist in
understanding the intent of the Contract Document; and assist
CITY's ENGINEER and SUPERVISORn serving as CITY's liaison
with CONTRACTOR when CONTRACTOR'soperations affect on-site
operations.
b. Assist in obtaining from CITY additional details or
information, when required for proper execution of the work.
4. Shop Drawinas and Samples:
a. The INSPECTOR shall be familiar with all drawings and
specifications of the construction project.
b. Record date Of receipt of Shop Drawings and samples.
C. Receive samples which are furnished at the site by CONTRACTOR,
and notify SUPERVISOR and CITY's ENGINEER of availability of
samples for examination.
d. Advise SUPERVISOR and CITY's ENGINEER and CONTRACTOR of the
commencement of any work requiring a shop Drawing o ample if
thsubmittal has not been approved by the CITY's ENGINEER.
5. Review of Work, HCjection of Defective Work

CITY'S ENGINEER in determining if the Work in general
proceeding in accordance with the Contract Documents.

b. Report to SUPERVISOR and CITY 'a ENGINEER whenever INSPECTOR
believes that any Work is unsatisfactory, faulty or defective
or does not conform to the Contract Documents, or has been
damaged, or does not meet the requirements of any inspection,
test or approval required to be made; and advise SUPERVISOR
and CITY's ENGINEER of Work that INSPECTOR believes should be
corrected or rejected or should be uncovered for observation,
or requires special testing, inspectionor approval.
c. INSPECTOR will schedule all required testing for the Project
and determine the extent and frequency of such tests. All
.pertinent test results shall be recorded by the INSPECTOR in
the appropriate log.
d. Verify that tests, equipment and systems startups and
operating and maintenance trainingar conducted in the
presence of appropriate personnel,and the CONTRACTOR
maintains adequateeCords thereof; and observe, record and
report to SUPERVISORand CITY'S ENGINEER appropriate details
relative to the test procedures and startups.
e. Accompany visiting inspectors representing public or other
agencies having jurisdiction over the Project, record the
sults of these inspections and report to SUPERVISOR and
CITY'S ENGINEER.
I. All grades and ties established by CONTRACTOR will be checked
by the field inspectors and noted in a field book.
6. Interpretation of Contract Documents: Report to SUPERVISOR and
CITY'S ENGINEER when clarifications and interpretations of the
Contract Documents are needed and transmit t0 CONTRACTOR
clarifications and interpretations as issued by CITY'S ENGINEER.
7. Modifications: Consider and evaluate CONTRACTOR'S suggestions for
modifications in DrawingsoSpecifications and report with
INSPECTOR'S recommendations to SUPERVISOR and CITY's ENGINEER.
Transmit to CONTRACTOR decisions as issued by CITY'S ENGINEER.
E. Records:
a. Maintain at the job site orderly files for correspondence,
reports of job conferences, Shop Drawings and samples,
reproductions Of original Contract Documents including all
Work Directive Changes, Addenda, Change Orders, Field Orders,
additional Drawings issued subsequent to the execution of the
Contract, CITY'S ENGINEER's clarifications and 'interpretations
of the Contract Documents, progress reports, and other Project
related documents.
b. Keep a diary or log book, recording CONTRACTOR hours on the
job site, weather conditions, data relative to questions of
Work Directive Changes, Change Orders or changed conditions,
list of job site visitors, daily activities, decisions,
observations in general, and specific observations in more
detail as theof observing test procedures; as directed
by SUPERVISOR, and send copies to CITY'S ENGINEER.

c. Record names, address and telephone numbers of all
CONTRACTORS, subcontractors and major supplies of materials
and equipment.
9. Reports:
a. Furnish periodic reports as required by SUPERVISOR of progress
of the Work and Of CONTRACTOR's compliance with the progress
schedule and schedule of Shop Drawing and sample submittals.
b. Consult with SUPERVISOR and CITY's ENGINEER in advance of
scheduled major tests, inspections or start of important
phases of the Work.
c. Draft proposed Change Orders and Work Directive Changes,
obtaining backup material from CONTRACTOR and recommend to
SUPERVISOR and CITY's ENGINEER Change Orders, Work Directive
Changes, and Field Orders.
d. Reportn mmediately to SUPERVISOR and CITY's ENGINEER and CITY
upon theoccurrence of any accident.
10. Payment Reouests: Review applications for payment with CONTRACTOR
and SUPERVISOR for compliance with the established procedure for
their submission and forward with recommendations to CITY's
ENGINEER, noting particularly the relationship of the payment
requested to the schedule of values, Work completed and materials
and equipment delivered at the site but not incorporated in the
Work.
11, Certifigatec, Maintenanced Operation Manuals: During the
course of the Work,vrity that certificates maintenance and
operation manuals and other data required to be assembled and
furnished by CONTRACTORrapplicable to the items actually
installed and in accordance with the Contract Documents, and have
this material delivered to CITY 'a ENGINEER forr eview and
forwarding to CITY prior to final payment for the Work.
13. Completion:
a. Before CITY's ENGINEER issues a Certificate of Substantial
Completion, submit to CONTRACTOR a list of observed items
requiring completion or correction.
b. Conduct finallnspection in the company of SUPERVISOR, CITY's
ENGINEER, CITY and CONTRACTOR and prepare a final list of
items to be completed or corrected.
c. Observe that all items on final list have been completed o
corrected and make recommendations to SUPERVISOR and CITY's
ENGINEER concerning acceptance.

Performance RegmiKementa of INSPECTOR
1. The INSPECTOR shall report to work promptly at the time and place
established by the SUPERVISOR. The INSPECTOR shall be on duty at
all times at the site location assigned and any absence shall be
approved by the SUPERVISOR prior to its Occurrence. All hours
worked shall be reported to the SUPERVISOR after each day's work.
2. All equipment assigned to the INSPECTOR shall be maintained and
red for i a diligent and careful manner. Any loss or damage t0
the equipment shall be reported to the SUPERVISOR immediately.
3. The INSPECTOR shall conduct himself in a polite and proper manner
at all times.
4. The INSPECTOR shall attend class, train, and pass all licensing
requirements for operation of the Tmixler compaction/density
testing equipment if requested by the INSPECTION SUPERVISOR.
Dimitations of Authority
The INSPECTOR:
1. Shall not authorize any deviation from the Contract Documents Or
substitution of materials or equipment unless authorized by CITY's
ENGINEER and approved by SUPERVISOR.
2. Shall not undertake any Of the responsibilities of CONTRACTOR,
subcontractors or CONTRACTOR's superintendent.
3. Shall notad
vois directions relative to or assume
over any aspect issue
the methods, techniques,
sequences procedures of construction unless such advice or
directions are specifically required by the Contract Documents.
4. shall not advise on,
issue directions regarding or assume control
over safety precautionsand programs in connection with the Work.
S. Shall not accept Shop Drawing or sample submittals from anyone
other than CONTRACTOR.
6. Shall not authorise CITY to occupy the Project in whole or 1n
part.
]. Shall not participate in specialized field or laboratory tests or
inspections conducted by others except as specifically authorized
by CITY'S ENGINEER and approved by SUPERVISOR.
