Commentary:
The Committee to giantism PERC, made up of a group of communities using the PERC
facility. Is presently attempting to negotiate a contract revision with PERC,
and it is felt that the ultimate recommendation of the Committee may suggest
that a tipping fee increase should go into effect immediately.
It is felt that this Council Order is necessary to authorize the City Manager
to notify commercial haulers of the Pending tipping fee increase. so that they
may advise their commercial customers.

TnTi WHEREAS, the Penobscot Energy Recovery Company (PERC), the owners
of thewaste-to-energy solid waste incinerator in Orrington, have indicated
that substantial Increases in tipping fees will be necessary In order to
continue operation of the facility; and
WEEREAS, a report prepared by CSI Resource Systema. Inc. substantially verifies
the losses claimed by PERC, and
WHEREAS, the City Council, by Council Order N0. 90-20 passed December 11, 1989
has authorized the Committee t0 Anallze, PERC (CAP) to negotiate an agreement

their recommendations to the City Council for further action; and
WHEREAS. the negotiations which are presently underway indicate that a tipping
fee increase in the amount of nineteen dollars ($19) is probable, sub]ect to
the negotiation of other items, including the disposal of front and bypass
residue, and that said tipping fee increase may be= .recommended to become effective
as early as April 1, 1990, and
WHEREAS, it is recognized that commercial haulers will require reasonable notice

to infortheir customers of an impending tipping fee increase, now therefore be it
ORDERED, THAT, the City Manager be an hereby is authorized to advise the local
commercial haulers of a possible nineteen dollar ($19) increase in the tipping
fee, possibly to be 1u effect as early as April 1, 1990. subject to the approval
of an amendment to the PERC contract by the City Council.
