HomeMy WebLinkAbout1990-03-26 90-134 RESOLVELouncll Hcumr Date 3-26-90 Item No. 90-134 Item/Sub'ect Statement of Just Compensation for Certain Property 1 Located within the Area Adjoining Newbury, York, Responsible Department Legal Commentary: This "Statement of Just Compensation" is required under 30-A M.R.S.A, 5 5204(21.0) as part of the City's acquisition of remaining outstanding interests in the Gridley -Frasier Street development parcel. The procedure is .identical to that for the B-4 development parcel, also on the current Council agenda. No compensation is proposed for any of the interests to be extinguished. The Council should be aware that these actions will result in acquisition of 393 square feet of land owned by The Roman Catholic Bishop of Portland. It is still our intention to seek confirmation of this acquisition byexecution of a boundary line agreement with the Bishop, which will require Council approval. RESOLVED. WHEREAS, pursuant to 30-A N.R.S.A. 5 5204 and the City of Bangor's duly adopted Community Development Program, the City Council has adopted and approved Resolution No. 90-37 for the Condemnation of Certain Property Located Within the Area Adjoining Newbury, York, Boyd and Hancock Streets, Including Ways Formerly Known as Gridley Street, Frazier Street, and Church Lane; and WHEREAS, 30-A M.R.S.A. 5 5204 requires a statement of just compensation to be filed with the Superior Court and served upon interested parties; and WHEREAS, a nominal Bum constitutes just compensation for the interests taken Pursuant to the Resolution of Condemnation, inasmuch as the interests acquired are those remaining after prior acquisitions of the City; NOM, MERKFORE, By the City Council of the City of Hangars RESOLVED, THAT just compensation for the interests acquired pursuant to the above referred to Resolution of Condemnation Is hereby determined to be one dollar ($1.00) payable to each of the persons named below, or those claiming through them, who may be located with reasonable diligence, and one dollar ($1.00) for all Persons unknown or who may not be located with reasonable diligence.
