Commentary:
Under 30-A M.R.S.A. S 5204(2).(A), the attached "Statement of
Just Compensation" relative to the B-4 development parcel must
be filed with the Superior Court as part of the City's acquisition
of the remaining interests in this parcel. The Resolve awards
$327.00 £ora 327 square foot piece at the rear
of the parcel[
to which the City does.not have good title. The ownership of
this piece is unknown. The $327.00 figure was specified i
Council Resolve 90-33 which authorized this taking. Inaccordance
with 30-A M.R.S.A. y 5204(1)[ the Council may not vote to decrease
this amount. Council Resolve 90-33 based the $327.00 figure on
the $1.00/square foot price paid by Downtown Development Group
for the entire parcel.

RESOLVED.
WHEREAS, pursuant to 30-A M.R.S.A. S 5204 and the City of
Bangor's duly adopted Community Development Program, the City
Council has adopted and approved Resolution No. 90-33 for the
Condemnation of Property Located Within the Area Adjoining Main
Street, a tract owned by the Masonic Temple Association,
Development Parcel P-6, and a way formerly known as Hodsdon Street;
and
WHEREAS, 30-A M.R.6.A. 5 5204 requires a statement of just
compensation to be filed with the Superior Court and served upon
Interested parties; and
WHEREAS, a nominal am constitutes just compensation for
the interests taken pursuant to the Resolution of Condemnation,
inasmuch as the interests acquired are those remaining after prior
acquisitions of the City;
NOW, THEREFORE, By the City Council of the City of Bangor:
RESOLt'ED, THAT just compensation for the interests acquired
pursuant to the above referred to Resolution of Condemnation is
hereby determined to be one dollar ($1.00) payable to each of the
persona named below, or those claiming through them, who may be
located with reasonable diligence, and one dollar ($1.00) for all
persons unknownor who may not be located with reasonable
diligence.
