The Staff and the Maine National Guard over the past six months
have identified three projects for the Guard to undertake be-
ginning in June of 1990. These Projects are: The Hayford
Park parking: the clean up of soils at the Waterfront project
area; and reclamation of the Stearns Pit. The three projects,
as part of "Maine Street '90", passed Community and Economic
Development Committee on December 19, 1989. This order is to `
accept the three projects and authorize the City Manager to
sign an agreement allowing the Maine Army National Guard to
commence With the work.

MEMORANDUM OF AGREEMENT
BETWEEN
THE CITY OF BANGOR AND THE MAINE ARMY NATIONAL GUARD
13 December 1989
1. Reference, Department of Community and Economic Development
letter, City of Bangor, dated 21 September 1989.
2. The Maine Army National Guard will undertake the removal of the
undesirable soil at the old Irving Oil site an Front Street and
replace it with clean fill. This will be accomplished within the
following parameters:
a. city of Banger responsibilities:
Provide all necessary permits.
Provide soils analyst.
Provide any safety barriers required for public safety.
Provide traffic control support.
Provide gravel berm at treatment site.
Locate and mark any utilities on or near excavation site.
Provide any siltation materials required.
Dispose of any miscellaneous debris encountered.
Provide source of clean fill.
Provide General Liability Insurance
b. The city will provide a soils analyst during the excavation
phase to determine what soil is suitable to be left on site and
what soil must be removed to the treatment site located at Bangor
International Airport.
a. NO will aerate the soil on site by using a dozer with
rippers and/or a grader with scarifiers. Any soil determined
usable after on-site aeration will be placed in a Stockpile on the
gravel parking lot Southwest of the excavation site. Unusable soil
will be removed to the treatment site.
d. Actual amount of soil to be removed will be determined
during excavation phase. This will be dictated by tidal
fluctuations, subsurface timber Cribwork, bedrock/large rocks, and
type of equipment used by the National Guard.
e. Aeration of Soil at treatment Bite can only be accomplished

by the Guard on the scheduled work days. .Maximum depth of soil
will six inches at any one time to insure proper aeration.
f. Removal of treated Soil from treatment site is the Cityis
responsibility.
g. The Guard, as A minimum, Will fill the excavated site back
to original grade. My fill above that will depend on time and
equipment availability.
A. The project time schedule Will be April through August 1990
(tentative). During April 1990 additional teat pits will be dug
to determine amount and location of material to be removed.
3. The above scope of Work is based on the National Gestate
equipment, time available to complete work, 'end training value.

The Maine National Guard is proposing to undertake the -fol louring
Projects for the City of Bangor:
Hayford park: Scope. Orub and stockpile topsoil; OMtabliah
subgrade for parking lots and entrance road; haul gravel for parking
lots and entrance road; and rough grade parkinglots and roadway. -
Estimated value of National Guard work, $38,550.00.- -
Stearns pita Scope. elope existing banks; level stockpile
in center of pit; and level pit floor to allow for drainage.
Estimated value of National Guard work, $20,165.00.
Bangor waterfront: Scope. Excavate undesirable soil;
haul to DIA; and haul clean fill to replace excavated material.
Estimated value of National Guard work, $256,795.00. Draft scope of
work attached.
The value of the work to be undertaken by the National Guard i
based on preliminary review. The detailed scope of work will be s
outlined in a Memorandum Of Agreement to be developed by the units that will be completing the work. questions regarding the above
