Commentary:
As w all aware, Sam's Wholesale Club i under construction
n the MoganRoad area and is nearing completion. In endear to re-
ceiv
appropriate State Department of Environmental Protection per-
mits, the Wal-Mart Corporation was
required to undertake contain
traffic improvements in the Mall
r
a and to also commit to the City
of Bangor an additional sum as -thetraffic impact fee to be held
against future improvements required in the Hogan Road area.
Traffic improvements are currently under way. These include the
installation of a traffic light at Haskell Road, the removal of the
median on the bridge over 1-9S to allow for additional lanes.
Because of this project and other foreseen projects into the
future, the City will be required to undertake certain additional
improvements in the 'Mall a We a currently working with the
State Department of Transportation as well as local business owners
to review proposals and do preliminary engineering studies necessary
to further define these improvements. (Continued on next page.)

Commentary:
As the second element of their DEP approval, Sam's w required
to provide tothe City of Bangor a traffic impact fee. This fee is
n the amount of $20,000. Since this requirement occurred at a time
when the City did not have Ordinance allowances for impact fees, it
is necessary that we treat this i as a
contribution. The attached
Order would accept this contribution from and designate it to
be used for traffic improvements in the Hagan Road area. Under exist-
ing State law the City is required to expend this money within a ten
year period. We anticipate no problems in meeting this requirement;
however it is also included in the Order as a condition of acceptance
as a gift.
Your approval of this contribution and designation of it !or
future traffic improvements in the Hogan Road Area is "commended.

ORDERED,
THAT WHEREAS, the City of Bangor has proposed traffic
improvement projects in Its Capital Improvement Program for the
Mall Subarea of the City; and
WHEREAS, Wal-Mart Corporation has committed to making
certain short-term improvements on Hagan Road and to make a
contribution to future highway improvements in the area as a
condition of its Site Selection Law (DEP) approval;
NOW, THEREFORE BE IT ORDERED 2Y THE CITY COUNCIL OF THE CITY OF
DANOOR THAT the City Manager be instructed to accept the $20,000
contribution from Wal-Mart and place it i account hold
exclusively for share for highway and traffic improvements
n the Mail Area, such improvements to occur within the next ten
years.
